Special-Purpose Road Passenger-Transport Services – Providing Transport Services For Disabled Children Residing In The Ursynów District Of The Capital City Of Warsaw. Warsaw To Schools On The Route Home - Educational Institution - Home, Along With Providing Them With Proper Care During Transport On School Days In Accordance With The Calendar Of The 2026/2027 School Year. The Subject Of The Order Is: Transport Of 57 (Optional Option Up To 70) Disabled Children Residing In The Ursynów District - On The Route Home - Educational Institution - Home, Who Fulfill Compulsory Schooling Or Learning In Various Types Of Educational Institutions Adapted To Their Disabilities In The Capital City Of Warsaw And The Vicinity Of Warsaw, Along With Providing Them With Appropriate Care During Transport On School Days In Accordance With The Calendar Of The 2026/2027 School Year. The Subject Of The Order Is Specified In The List Of Children Covered By Transport. 1. Right Of Option The Ordering Party Informs That Due To A Possible Change In The Number Of Children During The Period Of The Order, The Ordering Party: 1) Introduces The Right Of Option, According To Which The Ordering Party May Increase The Number Of Transported Children To The Maximum Number Of Children (70) During The Term Of The Contract, In Accordance With The Description Of The Subject Of The Order; 2) The Option To Increase The Number Of Transported Children Will Apply To Children Registered For Transport Based On The Request Of The Parent/Guardian And Not Included In The List Received By The Service Provider. Any Changes Regarding Increasing Or Decreasing The Number Of Children Transported And Changes In Transport Routes Will Be Communicated To The Contractor By The Ordering Party In Writing; 3) If The Child Is Registered Under The Option, Transport Will Begin Within 7 Days Of Registration; 4) The Gross Rate For The Delivery Of 1 Child Will Be Constant Throughout The Duration Of The Contract. The Rate Will Not Be Negotiable. 2. Obligations Arising From The Social Clause 1) In The Proceedings In Question, The Ordering Party Defined The Requirements Related To The Implementation Of The Order In Terms Of Employment By The Contractor Or Subcontractor Based On The Employment Relationship Of Persons Performing The Activities Indicated Below. 2) The Ordering Party Requires That Activities Related To The Execution Of The Order For Transport Services For Disabled Children: Driving A Motor Vehicle (Drivers) And Caring For Children (Caregivers) Be Performed By Persons Employed Under An Employment Relationship By The Contractor Or A Subcontractor. 3) The Condition Referred To In Point 2 Will Be Met By Employing New Employees On The Basis Of An Employment Relationship Or Appointing Already Employed Persons To Perform The Order. 4) Detailed Requirements Regarding Employment Based On An Employment Relationship, In The Circumstances Referred To In Art. 95 Of The Public Procurement Law, In Particular The Method Of Verifying The Employment Of Persons Under An Employment Contract, The Employers Rights To Control The Contractors Compliance With The Above-Mentioned Requirements And Sanctions For Failure To Meet Them Are Specified In The Draft Provisions Of The Contract Constituting Annex No. 5 To The Swz. 5. A Detailed Description Of The Subject Of The Order Is Set Out In Annex No. 1 To The Swz, A Description Of The Subject Of The Order Along With A List Of Transport Routes For Disabled Children From The Ursynów District Of The Capital City Of Warsaw.
