The Scope Of The Order Includes The Supply Of Electricity For The Purposes Of Power Supply To Facilities Owned Or Managed By The Kędzierzyn-Koźle Commune And Municipal Legal Entities, Listed In Annex No. 11 - List Of Ordering Entities. 1. The Order Covered 869 Ee Consumption Points Supplying Buildings, Premises, Utility Facilities, Street Lighting, Street Traffic Lights And Water Supply, Sewage And Heating Installations. These Facilities, Their Administrators And Ee Collection Points Are Described In Detail In Annex No. 9 To The Swz - Ee Demand - Summary Table, Available In An Electronic Version On The Website Of The Conducted Proceedings, Constituting An Integral Part Of The Swz. 2. The Annual Demand For Electricity Was Set At 14,194,239.00 Kwh. This Is An Indicative Value. 3. The Division By Tariff Types Is Included In Annex No. 10 To The Swz - Balance Of Demand For Ee According To Tariffs. 4. Before Concluding A Detailed Agreement Or During Its Validity Period, The Ordering Party Reserves The Right To Choose A Different Tariff Than The One Currently Applicable For A Given Ee Consumption Point (Listed In Annex No. 9 To The Swz), Provided That The Requirements Set By The Distribution System Operator (Dso) Are Met. 5. Based On The General Contract Concluded By The Ordering Party With The Selected Contractor (Ee Supplier), Detailed Contracts Will Be Concluded By Individual Administrators Of The Facilities Where Individual Ee Consumption Points Are Located. 6. Determining The Expected Electricity Consumption Is An Element Used Only To Determine The Value Of The Contract And Does Not Constitute An Obligation Of The Ordering Party To Purchase Electricity In The Given Quantities. 7. Each Recipient Specified In Annex No. 11 To The Swz - List Of Ordering Entities Will Independently Conclude An Individual Contract For The Distribution Of Electricity. 8. A Detailed Description Of The Subject Of The Order Is Provided, Among Others, By: The Draft Provisions Of The Contract And Annexes Posted In Electronic Version On The Website Of The Proceedings Being Conducted, Constituting An Integral Part Of The Swz. B. Requirement Of Employment Under An Employment Contract. Pursuant To Section 95 1 Of The Public Procurement Act, The Ordering Party Does Not Require Employment By The Contractor Or Subcontractor On The Basis Of An Employment Relationship. C. Option Right: 1. The Ordering Party Provides For The Possibility Of Exercising The Option Right Referred To In Art. 441 Section 1 Of The Public Procurement Law, Including The Possibility Of Increasing The Supply Of Electricity Under The Terms Of The Contract By Another 10% Of The Basic Order, In A Situation Where, After The Tender Procedure, New Energy Consumption Points Are Created Or In The Event Of An Increase In The Demand For The Supply Of Electricity To Ppes Listed In Annex No. 9 To The Swz - Electricity Demand. 2. The Option Right Is The Right Of The Ordering Party, Which He May, But Does Not Have To, Exercise As Part Of The Implementation Of This Contract. 3.
