1. The Subject Of The Order Includes The Reconstruction Of The Municipal Road No. 125010N Solkieniki - Silginy In The Barciany Commune, Consisting In Particular Of: 1) Preparatory Works, 2) Construction Layers Of The Road Surface And Passing Areas, 3) Construction Of The Road Surface And Passing Areas, 4) Construction Of Roadsides.2. The Detailed Scope Of The Subject Of The Order Is Included In The Design Documentation And The Technical Specification For The Execution And Acceptance Of The Works - Annexes No. 5.1 - 5.16 And 6 To The Specification Of The Terms Of The Order, Hereinafter Referred To As The Swz. The Bill Of Quantities Constituting Annex No. 7 To The Swz Is Treated Only As Illustrative Material And Does Not Constitute A Description Of The Subject Of The Contract Within The Meaning Of Art. 103 Pzp.3. Design Documentation Or Technical Specifications For The Execution And Acceptance Of Works May Indicate Trademarks Or Origin For Certain Materials Or Products. The Ordering Party Allows The Offer Of Materials Or Products Equivalent To Those Indicated In The Design Documentation Or The Technical Specification For The Execution And Acceptance Of The Works, Provided That They Guarantee The Implementation Of The Subject Of The Order In Accordance With The Decisions Obtained, Ensure That The Effect Is At Least At The Same Level As Assumed In The Design Documentation And The Technical Specification For The Execution And Acceptance Of The Works, And Are Not Inferior In Terms Of: 1) Functional Nature (Identity Of Function), 2) Technical Parameters (Strength, Durability), 3) Safety Parameters Of Use.4. In Each Case When The Ordering Party Refers To Standards, European Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems In The Design Documentation Or Technical Specification For The Execution And Acceptance Of Works, Solutions Equivalent To Those Described Are Allowed.5. All Materials And Products Used During The Execution Of The Subject Of The Order Must Be New And Meet The Marking And Conformity Assessment Requirements Specified In The Act Of April 16, 2004 On Construction Products (Journal Of Laws Of 2021, Item 1213).6. The Contractor Is Obliged To Perform The Order In Accordance With The Principles Of Contemporary Knowledge, Applicable Regulations, Standards And With Respect For Occupational Health And Safety Principles.7. In The Event Of Interpretation Discrepancies Between The Provisions Of The Swz And The Draft Provisions Of The Contract And The Content Of The Remaining Annexes To The Swz, The Provisions Of The Swz And The Draft Provisions Of The Contract Shall Prevail.8. The Subject Of The Order Is Co-Financed By The Government Road Development Fund.
