Tenders are invited for Appointment of a Technical Expert to Develop an Opinion Paper on Law Reform for Drug Use and Drug Possession for Access to HIV Health Services. Closing Date: 9th of June 2026 SCOPE OF WORK The technical expert is expected to write a comprehensive Legal Opinion Paper with a Shadow Bill or Model Bill as an output Annexure; that should serve as an advocacy reference document for law reform on punitive legislations impacting Key Populations and KVPs who use drugs in the Global Fund supported HIV Programmes in South Africa. This Legal Opinion paper should serve as a reference document for law makers and advocates to be used in the review of legistion that directly or indirectly prevents KVP who use and inject drugs from accessing health services, thereby infringing on their rights to health and human dignity. The Legal Opinion paper should review the history of laws related to drug use, drug possession and prohibition in South Africa; the current legal framework and relevant jurisprudence within the criminal justice system including relevant Case Law; the subsequent impact and implications of current legistion to accessing health services by KVP who use and inject drugs; the costs to their human rights to health and financial costs on the South African public health system. The Legal Opinion Paper should collate clear and comprehensive recommendations with actionable steps on a human rights based law reform criminal justice system based on the current legal framework that prioritises public health and assures access to health, social and legal services of KVP who use and inject drugs, promotes human rights and harm reduction principles. The analysis and recommendations should include a Model Bill or Shadow Bill as an Appendix to the Legal Opinion with clear human rights informed and evidence-based position statements and justifications on the following key areas among others: 1. The decriminalisation of drug use and possession 2. Types of drugs and threshold quantities for personal use 3. Harm reduction services 4. Access to health and social services 5. Alternatives to arrest and Incarceration 6. Protection from human rights violations 7. Stigma and discrimination reduction 8. Gender and vulnerability considerations 9. Community-led and peer-based approaches 10. Legal and policy alignment 11. Law enforcement reform 12.
