1. The Subject Of The Order Is The Successive Delivery Of Food Products For The Needs Of The Lublin University Of Technology. 2. A Detailed Description Of The Subject Of The Order Is Included In Annex No. 1 To The Swz - Description Of The Subject Of The Order.3. Place Of Delivery: Central Warehouse Of The Lublin University Of Technology, Ul. Nadbystrzycka 40A, 20-618 Lublin, Or Other Place Indicated By The Ordering Party On The Campus Of The Lublin University Of Technology At Ul. Nadbystrzycka 36-44 In Lublin. 4. The Contractor Is Fully Responsible For The Delivery Of The Subject Of The Contract. The Term Delivery Is Understood By The Ordering Party As The Contractors Delivery Of The Subject Of The Contract To The Ordering Partys Registered Office, Its Unloading And Bringing It To The Place Indicated By The Ordering Party, At The Time And Place Agreed With An Employee Authorized By The Ordering Party.5. The Contractor Undertakes To Deliver The Subject Of The Contract Using Its Own Transport, At Its Own Expense And Risk. 6. Packaging Should Protect The Product Against Damage And Contamination, And Should Be Clean Without Foreign Odors And Mechanical Damage.7. Food Products Should Be Delivered In Original, Factory-Sealed Packaging, Without Physical Signs And Traces Of Damage, And Have Information And Markings On The Packaging In Polish.8. If In The Description Of The Subject Of The Order The Ordering Party Specifies The Ordered Product Range By Indicating Trademarks Or Origin, The Ordering Party Informs That This Entry Is Only An Example And Constitutes An Indication For The Contractor What Features The Products Specified In The Description Of The Subject Of The Order Should Have. The Ordering Party In Accordance With Art. 99 Section 5 Of The Public Procurement Law, Allows Offering Equivalent Products. By Indicating The Designation Of A Specific Manufacturer (Supplier) Or A Specific Product In The Description Of The Subject Of The Order, The Ordering Party Also Allows Equivalent Products With Quality Parameters And Functional Features At Least At The Level Of The Parameters Of The Indicated Product, Thus Accepting Every Product With The Indicated Or Better Parameters. A Contractor Who Refers To Solutions Equivalent To Those Described By The Ordering Party Is Obliged To Demonstrate That The Products He Offers Meet The Requirements Specified By The Ordering Party. In Such A Situation, The Ordering Party Requires The Submission Of Appropriate Documents Confirming The Credibility Of The Offered Products.9. The Ordering Party, In Accordance With Art. 441 Pzp, Reserves The Right To Exercise The Option Right By Committing To Purchase 60% Of The Value Of The Subject Of The Order. The Purchase Of The Remaining 40% Will Depend On The Needs Of The Ordering Party, Which Cannot Constitute The Basis For Claims From The Contractor Due To The Unfulfilled Part Of The Contract.
