The Ordering Party Does Not Agree To Change The Delivered Product Range To One Other Than That Indicated In Annex No. 3 To The Swz (Price Form), With The Reservation That The Ordering Party Agrees To Change The Delivered Product Range To Another Than That Indicated In The Price Form According To Annex No. 3 To The Swz In Cases Where The Contractor Demonstrates That The Offered Product Range Has Been Withdrawn From Sale Or Its Production Has Ceased, There Is No Access To It On The Polish Market (Confirmed By The Manufacturer Or Sales Representative On The Polish Market) The Ordering Party Allows The Possibility Of Offering And Delivering A Different Product Range, Provided That Its Requirements Are Met (Which The Ordering Party Has The Right To Check) Before Giving Consent, And The Price Is Not Higher Than That Offered In The Price Form, And The Contractor Must Obtain The Ordering Partys Consent To Change The Offered Product Range. The Ordering Party Requires That The Entire Product Range Is Brand New, Free From Technical And Legal Defects, Approved For Trading, Grade I, And Meets The Quality And Use Standards Indicated By The Ordering Party In Annex 3 To The Swz. The Ordering Party Requires The Contractor To Indicate The Manufacturer, Name, Symbol Or Other Data Enabling Clear Identification Of The Offered Product In Annex No. 3 To The Swz, Price Form, Column 10. Failure To Enter The Manufacturer, Name, Symbol Or Other Data Enabling Clear Identification Of The Offered Product In The Price Form Will Result In Rejection Of The Offer Pursuant To Art. 226 Section 1 Point 5 Of The Act As Inconsistent With The Terms Of The Order. The Offered Assortment Should Meet All The Requirements Of The Standards Specified By Applicable Law. The Ordering Party Requires The Contractor To Provide A Minimum Warranty For The Offered Products Covered By The Subject Of The Order, I.E. 12 Months, 24 Months And 36 Months From The Date Of Delivery In Accordance With The Requirements Indicated In Column 2 For Each Item In The Price Form - Annex No. 3 To The Swz. The Ordering Party Requires That During The Warranty Period All Costs Related To Warranty Service, Including Transport, Be Borne By The Contractor. Settlement Will Be Based On Actually Completed Successive Deliveries In Accordance With The Needs Of The Ordering Party, According To The Offered Gross Unit Prices, Subject To § 7 Of The Draft Provisions Of The Contract. The Value Of The Contract Will Be The Amount That The Ordering Party Intends To Allocate To Finance The Order, Given Before The Opening Of Offers. The Gross Price Calculated In Accordance With Section Xvii Of The Swz Should Be Provided In Order To Select The Most Advantageous Offer. If The Price Of The Most Advantageous Offer Exceeds The Amount That The Ordering Party Intended To Allocate For Implementation, The Ordering Party Will Decide Whether It Will Conclude The Contract Up To The Amount Of Funds It Has, Whether It Will Increase The Funds Allocated For Implementation, Or Whether It Will Cancel The Contract.
