1. The Subject Of The Order Is The Supply Of Single-Use Products, The Detailed Description, Range, Estimated Quantities And Requirements Of Which Are Specified In Annex No. 5 To Swz.2. Failure To Meet At Least One Of The Requirements Specified In Annex 5 To The Swz Will Result In Rejection Of The Offer. 3. The Product Range That Is The Subject Of The Order Must Be Approved For Trading And Use In Health Care Facilities In The Republic Of Poland, In The Case Of The Product Listed As Medical, In Accordance With The Act Of April 7, 2022 On Medical Devices (Consolidated Text, Journal Of Laws 2022, Item 974) And Be Compliant With European Union Law. Products Must Have Declarations Of Conformity And Ce Certificates For The Offered Medical Device. 4. The Offered Products Must Be New, Unused, And The Minimum Shelf Life Of The Offered Products Must Be Half The Period Guaranteed By The Manufacturer. In The Case Of A Shorter Period, Prior Consent Of The Pharmacy Manager Will Be Required.5. Delivery Of Disposable Products Will Be Based On Partial Orders. Maximum Delivery Time: No Longer Than 2 Business Days From The Date Of Placing The Order By Fax, Telephone Or E-Mail By The Ordering Party. If The Delivery Falls On A Non-Working Day, The Delivery Will Take Place On The First Business Day After The Scheduled Date.6. The Contractor Will Be Obliged To Deliver The Ordered Assortment At His Own Expense And Risk.7. The Ordering Party Emphasizes That The Quantities Given In Annex 5 To The Swz Are The Estimated Demand For The Duration Of The Contract. The Ordering Party Reserves The Right To Use Only Partial Quantities Of The Product. The Ordering Party Will Use 60% Of The Quantity Of Products Specified In The Package. The Remaining 40% Of The Quantity Of Products Will Be Used By The Ordering Party If Necessary. The Contractor Is Not Entitled To Any Claims For Damages Against The Ordering Party For Not Using The Full Quantity Of The Product.8. The Collective Packaging Of The Delivered Product Must Be Marked In A Way That Identifies The Product. 9. Wherever The Subject Of The Order Is Described By Indicating Trademarks, Patents Or Origin, Source Or Specific Process That Characterizes The Products Or Services Provided By A Specific Contractor, The Ordering Party Allows The Contractor To Use Solutions Equivalent To Those Described In The Procedure Documentation, Provided That They Will Have At Least The Same Or Better Technical And Functional Parameters And Will Not Lower The Standards Specified In The Documentation. 10. If The Contractor Proposes An Equivalent Product Range, He Is Obliged To Prepare And Attach To The Offer A List Of All Proposed Equivalent Items And Demonstrate Their Equivalence To Those Described In The Documentation Constituting The Description Of The Subject Of The Contract, Indicating The Name, Page And Item Of The Description Of The Subject Of The Contract To Which It Applies. 11.
