The Subject Of The Order Is The Provision Of Equipment Services (Service On The Contractors Side) At The Czysta Błękitna Kraina Sp. Waste Management Plant. Z O. O. In Czarnówek, Equipment At The Contractors Disposal In The Quantity And On The Terms Described Below. A Wheeled Loader, Front-Articulated With A Hight-Lift Arm, Having: - Height To The Bucket Joint Pin Of At Least 4,500 Mm (The Use Of A Bucket With A High Dumping Height Is Excluded); - Equipment Weight Of At Least 16,000 Kg; - Bucket Capacity Of At Least 3.0 M3; - Equipment Operator On The Contractors Side. The Expected Number Of Working Hours Is Approximately 1,008 Working Hours. The Number Of Hours Is Only An Estimated Number Necessary To Calculate The Price Of The Service. The Ordering Party Guarantees A Minimum Of 8 Man-Hours Of Work Per Day From 7:00 A.M. To 3:00 P.M. The Ordering Party Reserves The Right To Use The Equipment Constituting The Subject Of The Order For A Smaller Number Of Working Hours, But Not Less Than 560 Man-Hours (Minimum Benefit). For This Reason, The Contractor Will Not Be Able To Claim Compensation For The Uncompleted Part Of The Order. All Costs, Including Those Related To Travel And Arrival At The Place Of Execution Of The Contract, As Well As The Costs Of Materials (E.G. Fuel) Needed To Complete The Task And Operate The Machine By The Operator, Are Borne By The Contractor, Without The Right To Return Them From The Ordering Party. Delivery And Collection Of The Machine Included In The Price. The Contractor Is Obliged To Train Its Employees In The Field Of Work Technology And Equipment Operation As Well As Health And Safety Conditions For The Services Covered By The Contract. The Equipment Must Have Valid Third Party Liability Insurance And Technical Tests Allowing It To Be Used. The Contractor Is Responsible For The Technical Condition Of The Equipment And Any Damage To Third Parties Resulting From The Services Provided. Upon Loading, The Risk Of Accidental Loss Or Destruction Of The Material Is Borne By The Contractor. The Contractor Will Provide Its Own Repair And Renovation Services For The Equipment Intended To Perform The Services. The Contractor Is Responsible For Compliance With Health And Safety, Fire Protection And Road Traffic Regulations When Providing Services. The Ordering Partys Temporary Resignation From The Services Provided Using The Equipment Is Not Final And, In Particular, Does Not Constitute A Basis For Concluding That In Further Periods Of The Contract The Ordering Party Will Not Have The Right To Demand Services Provided Using The Equipment Which It Previously Resigned From Using. The Contractor Should Conclude, At His Own Expense, Civil Liability Insurance Contracts For His Business Activities And Insurance For The Means Of Transport For The Duration Of The Services Covered By The Contract. The Contractor Is Liable To Third Parties And Bears All Costs For Material Losses Arising In Connection With The Occurrence Of Fortuitous Events
