1. The Subject Of The Order Is: Purchase And Delivery Of A Computing Server Set For Artificial Intelligence Applications (Server + 2 Monitors + Accessories) – 1 Pc.2. The Description Of The Subject Of The Order Is Attached As Annex No. 1A To Swz.3. Requirements Regarding The Subject Of The Order3.1. The Subject Of The Order Will Be Delivered To The Ordering Party At The Contractors Risk And Within The Remuneration (Specified In The Offer) Due To The Contractor.3.2. As Part Of The Proper Performance Of The Subject Of The Order, The Contractor Is Obliged To Deliver And Bring The Complete And Assembled (On-Site Assembly Is Allowed) Subject Of The Order (With Parameters Specified In The Description Of The Subject Of The Order) To The Room Indicated By The Ordering Party, Within The Time Specified In Point. 4 Swz. If Additional Materials, Elements And Equipment Are Required For The Delivered Subject Of The Order, The Contractor Is Obliged To Provide Them As Part Of The Remuneration Specified In The Offer.3.3. The Contractor Must Offer To Implement The Subject Of The Order In Accordance With The Employers Requirements Specified In The Swz And Annexes And Cover The Entire Scope Of The Subject Of The Order With The Offer.3.4. All Requirements Specified In Annex No. 1A To The Swz - Description Of The Subject Of The Order/Agreement Constitute Minimum Requirements And Their Fulfillment Is Obligatory. Failure To Meet The Above-Mentioned Minimum Requirements Will Result In Rejection Of The Offer Pursuant To Art. 226 Section 1 Point 5 Of The Public Procurement Law, As Inconsistent With The Terms Of The Order.3.5. The Subject Of The Contract Must Meet All The Requirements Of A Safe Product In Accordance With Regulation (Eu) 2023/988 Of The European Parliament And Of The Council Of 10 May 2023 On General Product Safety, Amending Regulation (Eu) No 1025/2012 Of The European Parliament And Of The Council And Directive (Eu) 2020/1828 Of The European Parliament And Of The Council And Repealing Directive 2001/95/Ec Of The European Parliament And Of The Council Of The European Union And Of The Council And Council Directive 87/357/Eec Of 10 May 2023 (Oj Eu No. 135, P. 1). In Cases Where The Description Of The Subject Of The Order Would Indicate Trademarks, Patents, Origin, Source Or Specific Process Characterizing Specific Products Or Services, This Means That The Ordering Party Cannot Describe The Subject Of The Order In A Sufficiently Precise And Understandable Way And This Is Justified By The Specificity Of The Subject Of The Order.
