1. Description Of The Subject Of The Order: A) The Subject Of The Order Is Construction Work Consisting In The Reconstruction Of Ul. Rybitwy On The Section From Ul. Szparagowa To Ul. Rybitwy 88A,B) The Ordering Party Described The Subject Of The Contract Using The Following Documents:1) Designed Provisions Of The Contract (Ppu) - Annex No. 2 To The Swz,2) Technical Specification For The Execution And Acceptance Of Construction Works (Stwiorb) - Annex No. 8 To The Swz,3) Design Documentation - Annex No. 9 To The Swz,4) Bill Of Quantities - Annex No. 10 To The Swz,C) The Contractor Is Obliged To Provide A Quality Guarantee For The Subject Of The Contract For A Minimum Period Of 36 Months, A Maximum Period Of 60 Months. Offers Containing A Quality Guarantee Period For The Subject Of The Contract, Shorter Than 36 Months, Will Be Rejected As Not Meeting The Requirements Of The Swz.2. The Subcontracting Agreement, The Subject Of Which Is Construction Works, Should Be Consistent With Annex No. 2 To The Swz, I.E. Ppu. Failure To Meet A Given Condition Will Result In The Ordering Party Submitting Reservations Or Objections, Respectively.3. The Ordering Party, In Accordance With Art. 95 Section 1 Of The Public Procurement Law, Requires The Contractor Or Subcontractor To Employ, Under An Employment Relationship, Persons Performing The Activities Indicated Below, With The Exception Of Persons Performing The So-Called Independent Technical Functions In Construction Within The Meaning Of The Construction Law: • Lower-Level Technical Employees (Organization And Implementation Of Construction Works), • Manual Workers (Direct Performance Of Construction Works). The Ordering Party Allows For The Possibility Of Personal Execution Of The Order By Persons Running A Business Or Partners Of A Commercial Law Company.4. Before Signing The Contract And During Its Implementation, The Ordering Party Has The Right To Check Whether The Contractor Or Subcontractor Meets The Requirement Specified In Point 3 In Part 1 Of The Swz, In Accordance With The Provisions Of The Ppu.
