1. The Subject Of The Order Is The Purchase Of An Identity Management System - Idm System. The Task Is Carried Out As Part Of The Project Entitled Cybersecure Jasło, Co-Financed By The European Regional Development Fund (Erdf) Under Priority Ii Advanced Digital Services Of The European Funds For Digital Development (Ferc) Program, Together With Delivery To The Headquarters Of The Ordering Party Or Equivalent Software. 2. A Detailed Description Of The Subject Of The Order Is Included In Annex No. 4 To The Swz (Description Of The Subject Of The Order). 3. Equivalence: A) The Ordering Party, In The Case Of Describing The Subject Of The Order Using Characters Trademarks, Standards, Patents Or Origin, Source Or Specific Process Referred To In Article 101, Sections 4-5 Of The Act, Indicates That It Allows Solutions Equivalent To Those Described In Terms Of The Adopted Technical Solutions, Materials, Products And Standards, Provided That Those Proposed In The Offer Are Significantly Equivalent To Those Specified In The Design Documentation. B) If The Description Of The Subject Of The Contract Includes Any Trademarks, Patents, Standards Or Other Reserved Or Exclusive Rights, Or The Origin Of The Subject Of The Contract Is Specified Or Part Thereof - It Should Be Assumed That The Ordering Party, Due To The Specificity Of The Subject Of The Order, Has Provided Such A Description With An Indication Of The Type And Allows The Submission Of Offers Equivalent In Terms Of Functionality And With Technical And Operational Parameters Not Worse Than Those Specified In The Description Of The Subject Of The Order. In Such A Case, The Contractor Is Responsible For Proving Their Equivalence With The Requirements Indicated By The Ordering Party Together With The Offer (Not Subject To Supplementation), The Contractor Will Submit A List Of Equivalent Materials Together With Other Necessary Documents Confirming The Fulfillment Of The Above-Mentioned Requirements, E.G. Device Cards, Safety Certificates, Declarations Of Conformity, Technical Approvals, Etc. C) The Ordering Party Will Consider The Products Offered By The Contractor To Be Equivalent In Terms Of Functionality, Technical And Utility In Relation To The Indicated Subject Of The Order, Having A Technically Equivalent Structure And Equipment, As Well As Such Functional Capabilities And Technical Parameters As Products With The Given Reference Parameters Included In The Description Of The Subject Of The Order. D) The Ordering Party Has Made Every Effort To Maintain The Conditions For Competitiveness. If, Nevertheless, Proper Names, Markings Or Parameters Indicating A Specific Product Appear In The Text Of Any Type Of Documentation, They Should Always Be Treated As Exemplary Solutions And Equivalent Solutions May Be Used Under The Above-Mentioned Conditions.
