Supervision Of Building Work - Services Of The Contract Engineer, Including Preparatory, Settlement And Investor Supervision Services For The Investment Entitled: Construction Of A Water Recreation Facility (Aquapark) With Accompanying Infrastructure And Construction Of Outdoor Swimming Pools Complementing The Offer Of Aquapark In Opole. 3.1. The Subject Of The Engr. Agreement, Hereinafter Referred To Interchangeably As The Contractor, Is The Provision By The Engr. To The Ordering Party Of Services Related To The Proper Implementation Of The Investment, Including Investor Supervision Services Over The Wrb Agreement And The Services Of The Contract Engineer And Settlement Of The Investment. The Scope Of Duties Of The Engineer Will Include In Particular: A. Acting As The Investor Supervision Inspector Under The Wrb Agreement; B. Acting As A Coordinator Of The Activities Of Investment Supervision Inspectors; C. Financial Management, Including Taking Into Account The Requirements Arising From The Agreement On Financing In The Form Of A Grant Or Loan (If Such An Agreement Is Concluded By The Ordering Party); D. Control, Technical Advice, Supervision, Including Geodetic, Geotechnical And Hydrogeological Supervision Over The Implementation Of The Investment; E. Impartial And Objective Participation In The Investment Process Covered By The Investment; F. Comprehensive Activities Related To The Preparation Of Documentation For The Aquapark For Use, Including Compliance With The Provisions Of Generally Applicable Law And Its Operation By The Ordering Party; G. Performing Multi-Discipline Investor Supervision And Acting As The Contract Engineer During The Investment Implementation Phase, Described In Detail In The Opz And The Engr. Agreement. This Scope Includes, First Of All, Full Management Of The Wrb Contract, Coordination Of All Industries, Supervision Over The Quality And Timeliness Of Works, Verification Of Material Applications In Terms Of Compliance With The Design Documentation, Occupational Health And Safety Management At The Construction Site And Supervision Of Acceptance Activities Until Wrb Obtains The Final Occupancy Permit. H. Specifying To The Ordering Party All Necessary Decisions, Consents, Permits, Opinions, Arrangements, Etc., Necessary For The Proper Commencement, Implementation, Acceptance And Acceptance In Accordance With The Law. Exploitation Of The Investment, Within 14 Days From The Date Of Signing The Ci Agreement - In The First Preliminary Report. The Preliminary Report Should Also Indicate Which Documents The Ordering Party Is Responsible For Obtaining And Which Wrb Are Responsible For Obtaining; I. Verification Of The Opz Wrb In Terms Of Correctness Of Its Preparation, Specification Of Any Noticed Irregularities, Errors, Issues That Could Prove Problematic At The Stage Of Investment Implementation, Including Possible Requests By The Wrb For Additional Or Replacement Works, Reporting Time Or Financial Claims By The Wrb; J. Supervision By The Engineer Of The Performance Of Additional Or Replacement Works By Wrb Under The Wrb Agreement; K. Mediation And Arbitration In Disputes Between The Ordering Party And Wrb; L. Preparing Applications For Interim Payments And Final Payment Applications As Part Of The Investment Settlement; Supporting The Ordering Partys Activities Related To The Settlement Of The Investment; M. Supervision Over The Implementation Of The Ordering Partys Rights And Wrb Obligations Arising From The Guarantee Or Warranty For Defects To The Extent Indicated In The Engr. Or Opz Agreement; N. Settlement Of The Wrb Agreement And The Investment, Both With The Wrb (Including The Verification Of Documents
