Banking Services - Performing Banking Services For The Bytom Budget And Granting A Short-Term Loan In The Main Account. 1. The Subject Of The Order Is To Provide Banking Services To The Bytom Budget And To Grant A Short-Term Loan In The Basic Account. 2. A Detailed Description Of The Subject Of The Order And The Detailed Terms And Conditions Of The Contract Are Included In The Annexes To The Specification: Description Of The Subject Of The Order With A List Of Units And The Proposed Contractual Provisions. Additionally, The Annex To The Specification Contains Documents Used To Assess The Financial Situation Of The Ordering Party. The List Of Attachments Is At The End Of The Document. 3. The Order Was Not Divided Into Parts. The Issue Of Divisibility Of The Provision Is Not Regulated In The Public Procurement Law (Pzp), Therefore, In Accordance With Art. 8 Section 1 Of The Public Procurement Law, The Ordering Party Shall Apply The Provisions Of The Civil Code In This Respect, In Particular Art. 379 §2: Performance Is Divisible If It Can Be Partially Fulfilled Without A Significant Change In Its Object Or Value. The Order Will Be Implemented As Part Of Comprehensive Banking Services, In Which The Contractor Will Ensure The Continuity And Integrity Of The Services Provided Throughout The Entire Implementation Period. The Specificity Of The Services Provided Under The Order Means That They Are Interrelated, And Dividing The Order Into Parts And Providing Individual Services By Different Entities Is Not Possible (The Service Of Maintaining Accounts And Granting A Loan On A Current Account Must Be Provided In The Same Bank). Taking The Above Into Account, It Should Be Considered That The Service Cannot Be Partially Fulfilled Without A Significant Change In The Subject Matter, Which Means That It Should Be Treated As One Whole (The Service Of Maintaining Accounts And Granting An Overdraft Facility Must Be Provided By The Same Bank). 4. The Ordering Party Does Not Envisage Awarding Contracts Referred To In Art. 214 Section 1 Point 7 Of The Public Procurement Law. 5. Ordering Party - In Connection With Art. 441 Section 1 Of The Public Procurement Law - Provides For The Possibility Of Exercising The Option Right Up To 50% Of The Value Of The Basic Order (Offer Price) And May Concern The Provision Of Banking Services For The Bytom Budget And Granting A Short-Term Loan In The Basic Account. The Option May Be Exercised To A Full Or Limited Extent. A Detailed Description Of The Options Can Be Found In The Draft Contractual Provisions.
