Architectural, Construction, Engineering And Inspection Services – Cmayor/2025/24Y09/0006. The Purpose Of The Contract Is The Provision Of Technical Advisory Service To The Avsf In Various Works Related To Railway Safety Competencies. Among The Functions Assigned To The Avsf Are Those Of Ensuring The General Maintenance Of Traffic Safety On The Railway Network Under Regional Jurisdiction By Supervising Compliance With The Obligations Of The Different Actors In This Matter; Authorize The Entry Into Service Of The Structural And Functional Subsystems And The Entire Railway System As A Whole, As Well As Verify That They Maintain Their Requirements; Authorize The Putting Into Service Of Railway And Tram Rolling Stock, As Well As Supervise That Safety-Related Information Is Kept Up To Date; Issue, Renew, Modify Or Revoke The Safety Certificates Of Railway Entities, As Well As Subsequently Supervise Them; Propose, Prepare And Develop Technical Safety Standards And Supervise Their Compliance By Railway System Agents; Prepare Reports On Rail Transport Safety; Ensure The Correct Application Of Psychophysical Requirements In The Examinations For Working Personnel With Responsibilities In Traffic Safety. These Functions Involve The Preparation Of Technical Reports By Qualified And Specialized Personnel In Each Of The Matters Related To Railway Safety. The Benefits Included In This Service Contract Are Of An Intellectual Nature. None Of The Services Covered By The Service Contract Imply The Exercise Of Functions That Imply Direct Or Indirect Participation In The Exercise Of Public Powers Or In The Safeguarding Of The General Interests Of The Administration, Since These Functions Correspond To Public Officials, In Accordance With Art 9 Of Royal Legislative Decree 5/2015, Of October 30, Which Approves The Consolidated Text Of The Law Of The Basic Statute Of Public Employees, And Art. 17.3 Of Law 4/2021, Of April 16, On The Valencian Public Service. In The Same Terms, Art. 17 Of Law 9/2017, Of November 8, On Public Sector Contracts, By Which The Directives Of The European Parliament And Of The Council 2014/23/Eu And 2014/24/Eu, Of February 26, 2014 (Hereinafter Lcsp) Are Transposed Into The Spanish Legal System, Establishes That “Services That Involve The Exercise Of The Authority Inherent To Public Powers May Not Be The Subject Of These Contracts.” In This Sense, The Provisions Of The Instruction Of The Ministry Of Finance And Public Administrations, Of December 28, 2012, On Good Practices For The Management Of Contracting Of Services And Management Assignments, Must Be Taken Into Account, In Order To Avoid Incurring In Cases Of Illegal Transfer Of Workers, Instructions That Not Only Govern With Respect To The Assignments.
