The Subject Of The Order Is Supply Of Official Cars For The Municipal Guard Of The City Of Krakow Ii, St.Rl.261.12.2026. 2. The Ordering Party Does Not Allow The Submission Of Partial Offers. The Ordering Party Informs That In Accordance With Art. 91 Section 2 Of The Public Procurement Law, Did Not Divide The Contract Into Parts For Technical, Organizational Or Economic Reasons. The Provision Of Art. 46(1) Of Directive 2014/24/Eu Of The European Parliament And Of The Council Of 26 February 2014 On Public Procurement And The Provision Of Art. 91(1) Of The Public Procurement Law Does Not Require The Division Of The Contract, Which Establishes The Ordering Partys Right To Divide The Contract. The Decision In This Respect Is Left To The Autonomous Will Of The Ordering Party, Which In This Respect Is Guided By Its Own Needs And Requirements. According To The Ordering Party, The Lack Of Division Into Parts Will Not Distort Competition By Limiting The Ability Of Smaller Entities That Would Be Able To Properly Perform The Order To Apply For The Order. The Lack Of Division In This Case Does Not Affect The Group Of Contractors Applying For The Contract. The Ordering Party Did Not Divide The Order Into Parts Due To The Fact That Such A Division Would Pose Excessive Technical And Organizational Difficulties And Due To The Uniform Nature Of The Subject Of The Order (Delivery Of The Same Rebuilt Vehicles). The Possible Division Of The Contract Into Lots Would Not Increase Competitiveness In The Sector Of Small And Medium-Sized Enterprises - The Scope Of The Contract Is Typical, Impossible To Divide Further, Enabling Contractors From The Group Of Small And Medium-Sized Enterprises To Submit An Offer. 3. The Ordering Party Envisages The Application Of The Option Right Under The Specified Conditions: A) The Ordering Party Envisages The Application Of The Option Right In Accordance With Art. 441 Section 1 Of The Public Procurement Law. The Option Right Includes Increasing The Delivery By 1 (One) Vehicle (Car) With Technical Parameters Identical Or Equivalent To The Basic Order, In Accordance With The Provisions Of The Swz And The Description Of The Subject Of The Order (Opz - Annex No. 2 To The Swz) And With The Submitted Offer. B) The Contractors Remuneration For The Delivery Option Implemented Under The Law Will Be Determined According To The Unit Price Indicated In The Offer And Will Be Identical To The Remuneration For The Basic Order (In Relation To The Price For 1 Vehicle). C) The Option Right Includes The Optional Possibility Of Ordering Additional Delivery Of The Vehicle Based On The Submitted Declaration Of The Ordering Party Exercising The Option Right, Which Will Indicate The Delivery Date (Maximum 22 Weeks From The Date Of Submission Of The Declaration By The Ordering Party Via The Platform Referred To In Section Viii Point 1 Of The Swz, No Later Than December 22, 2026). D) Delivery Made Under The Option Right Must Meet All Conditions And Parameters Specified In The Tor And In The Order Documents, In The Same Manner And To The Same Extent As The Delivery Made Under The Basic Order. E) The Delivery Date Of The Option Covered By The Right Will Not Be Longer Than The Delivery Date
