A Detailed Description Of The Subject Of The Order And Technical Parameters Are Specified In: Bill Of Quantities - Annex No. 8 To The Swz, Technical Documentation - Annex No. 9 To The Swz And Technical Specification For The Execution And Acceptance Of Works - Annex No. 10 To The Swz.3. Due To The Adopted Nature Of The Contractors Remuneration (Lump Sum), The Bill Of Quantities Has Only An Informative Function.4. In The Case Of Requirements Regarding Functionality And Performance, It Guarantees Obtaining The Values Adopted In The Documents Describing The Subject Of The Order In Terms Of The Indicated Features, Parameters And Properties. If The Ordering Party Has Described The Subject Of The Order By Indicating Exemplary Trademarks, The Contractors Are Obliged To Offer The Subject Of The Order Specified In The Documentation Or With Equivalent Parameters. The Equivalent Subject Of The Order Must Be Indicated In The Offer (Point 10 Of The Bid Form) In A Way That Allows Its Identification (E.G. Name, Type/Model, Trademark, Manufacturers Brand), And The Burden Of Proving Compliance With The Parameters Required By The Ordering Party Lies With The Person Submitting The Offer. The Contractor Relying On Equivalent Solutions In Accordance With The Instructions Of The Public Procurement Office Must Demonstrate That The Offered Subject Of The Order Meets The Conditions Specified By The Ordering Party To An Extent Not Worse Than That Indicated In The Tor.
