1. Part I - Delivery Of Office Chairs For The Department Of Security And Crisis Management. 2. The List Of Armchairs Covered By Part I Of The Order Is Included In The Offer Form Constituting Annex No. 1 To The Terms Of Reference, Hereinafter Referred To As Swz. A Detailed Description Of Part I Of The Order Is Attached As Appendix No. 10 To The Swz. 3. The Description In Annex 10 To The Swz Contains Minimum Requirements, Which Means That The Contractor Can Offer Products With Better Technical Or Functional Parameters. 4. The Delivered Products Must Come From The Manufacturers Authorized Distribution Channel. The Use Of The Delivered Products By The Ordering Party Cannot Constitute An Infringement Of The Copyrights Of Third Parties. It Is Unacceptable For A Contractor To Offer Someone Elses Product Under His Own Brand While Concealing The Original Markings. If There Is A Suspicion Of Offering As Your Own Product That Exists Or Existed In The Offer Of Another Entity Under A Different Name, The Contractor Will Be Asked To Provide Explanations Regarding The Origin Of The Product And The Consent Of The Entity Holding The Rights To The Industrial Design Of A Given Product To Modify And Further Resell The Product Under A Different Name. If The Entity Holding The Rights To The Industrial Design Of A Given Product Does Not Consent To Further Resale Of The Product Under A Different Name, The Contractors Offer Will Be Rejected. 5. The Delivered Products Must Be Brand New, Unused, Not Subject To Any Repairs, Free From Defects, Fully Functional And Ready For Use In Accordance With Their Intended Purpose, Must Comply With Applicable Quality And Technical Standards, Cannot Be Encumbered With Any Third-Party Rights And Must Meet The Requirements Specified In The Swz. 6. The Ordering Party Requires That The Armchairs Included In Part I Of The Order Come From One Collection, I.E. They Have A Common Style, Color, Form And Details. 7. The Contractor Will Perform The Subject Of The Order Using Its Own Tools, Materials, Equipment And Transport. The Assembly Of The Products Will Involve Performing All Work And Services Necessary To Use Them In Accordance With Their Intended Purpose And Function, I.E., Among Others: On Setting, Adjusting, Screwing, As Well As Bringing In And Cleaning The Delivery Site. The Costs And Risks Of Transport, Delivery, Packaging, Insurance During Transport And Installation Of All Products Shall Be Borne By The Contractor.8. Delivery And Assembly Of Products Will Take Place On The Ordering Partys Working Days, Using The Contractors Own Efforts, At The Contractors Expense And Risk.9.
