The Public Contract To Be Awarded In Accordance With Art. 191, Para. 1 Item 2, In Connection With Art. 20, Para. 3, Item 2 Of The Civil Code, Given The Fact That It Can Be Performed By Certain Contractors, Due To The Existence Of Exclusive Rights, Including Intellectual Property Rights. Textbooks And Teaching Aids Are Subject To Copyright Within The Meaning Of Art. 3, Paragraph 2, Item 3 Of The Zapsp. According To Art. 18, Para. 1 Of The Same Law, The Author Has The Exclusive Right To Use The Work Created By Him And To Authorize Its Use By Other Persons. These Copyrights Have Been Granted By The Author To The Publisher By Means Of A Publishing Or Other Contract, From Which Derives The Right Of Reproduction/Printing And Distribution, Necessary For Participation In The Evaluation And Approval Procedure, According To Ordinance No. 10 Of 19.12.2017 On Knowledge Books, Textbooks And Teaching Aids. According To Art. 162 Of The Zpuo, The Minister Of Education And Science Approves A List Of Knowledge Books, Textbooks And Teaching Aids That Can Be Used In The System Of Preschool And School Education For The Relevant School Year, And The List Is Published On The Official Website Of The Ministry Of Education And Science Before The Beginning Of The School Year, I.E. As Long As The Relevant Publishing House Is Indicated In The Approved On The Basis Of Art. 162 Of The Zpuo List, It Is Indisputable That It Owns Copyright And Exclusive Rights To Issue And Distribute The Relevant Knowledge Books, Textbooks And Teaching Aids, And These Rights Are Recognized In Accordance With The Statutory Procedure By The Minister Of Education And Science. By Order No. Rd09-107/15.01.2026 Of The Minister Of Education And Science, He Approved A List Of Knowledge Books, Textbooks And Study Sets That Can Be Used In The System Of Preschool And School Education In The Academic Year 2026/2027. According To Art. 191, Paragraph 1, Item 2 Of The Civil Procedure Code, The Contracting Authority Sends An Invitation To Certain Persons When Awarding The Public Contract To Another Person Is Impossible Due To The Existence Of Copyright Or Other Intellectual Property Rights, Or Exclusive Rights Acquired By Virtue Of A Law Or An Administrative Act, As Well As When The Nature Of The Delivery Or Service Is Limited To A Precisely Defined Contractor For Reasons That Are Not Due To The Contracting Authority.
