Prior Information Notice For Public Road Transport Services – Direct Award Of Public Passenger Transport Services To Stadtwerke Münster Mobility Gmbh. The City Of Münster, As The Responsible Authority (Section 3 Paragraph 2 In Conjunction With Paragraph 1 Sentence 1 Öpnvg Nrw, Section 8A Paragraph 1 Sentence 2 Pbefg), Intends To Award A Public Service Contract (Öda) For Public Passenger Transport Services To The Yet-To-Be-Founded Stadtwerke Münster Mobility Gmbh (Currently Contact Via Stadtwerke Münster Gmbh, Hafenplatz 1, 048155 Münster,[email protected]) To Be Awarded Directly (Operator). The Intended Award Relates To Local Public Transport (Öpnv) Passenger Transport Services. S.V. § 8 Pbefg. The Öda To Be Awarded Includes All Public Transport Services In The City Of Münster As Described In The “Supplementary Document” (See 2.1.4 C. Below). This Includes Scheduled And Demand-Based Transport Services. These Are Regular Services In Accordance With Section 2 Paragraph 1 No. 3 Pbefg In Conjunction With. V. With §§ 42 – 44 Pbefg. In Connection With The Provision And Management Of Passenger Transport Services, The Öda Obliges The Operator To Provide The Necessary Vehicles And Operational Infrastructure. The Öda Will Contain Regulations According To Which The Transport Offering Must Be Adapted To Changing Transport Needs Or Financial Conditions, The Local Transport Plans In The Currently Applicable Version And Other Changing Circumstances Within The Framework Specified In The Öda (E.G. Technical Developments, Environmental And Climate Protection Concerns, Introduction Of Additional Public Transport). The Possible Changes Relate To The Type, Scope And Quality Of Passenger Transport Services And The Transport Tariffs. Changes Can In Particular Relate To: The Existence And Course Of The Lines, Timetables And Fares Offered, Form Of Service (Regular Scheduled Services, Special Types Of Scheduled Services, Regular Scheduled Services), Vehicle And Other Quality Standards. The Volume Of Traffic Recorded By The Öda Can Be Reduced Or Increased. Changes Can Also Take Effect At The Beginning Of The Öda’S Term. This Prior Information Applies To Additional Scheduled Services Due To Changes In The Above Sense. The Operator Should Be Granted An Exclusive Right For Traffic Within The Meaning Of Article 2 Lit. F Of Regulation (Ec) No. 1370/2007 In Accordance With And Within The Limits Of Section 8A (8) Pbefg. The Exclusive Right Serves To Protect The Transport Services That Are The Subject Of The Öda. All Regular Services That Are Necessary To Fulfill The Öda Are Protected. The Exclusive Right Protects The Service In Question From Traffic That Has A More Than Insignificant Impact On The Passenger Potential Of These Services, Provided That They Are Not Initiated By The Client Himself.
