Technical Assistance Services – Technical Assistance And Supervision Services Within The Contract Of Design And Execution Of Works For The Project Thickening Of The Support Network For Hydrographic Works On The Danube For The Purpose Of Developing And Maintaining The Waterway Infrastructure. Technical Assistance And Supervision Services Within The Contract Of Design And Execution Of Works For The Project Thickening Of The Support Network For Hydrographic Works On The Danube For The Purpose Of Developing And Maintaining The Waterway Infrastructure, In Accordance With The Requirements Of The Specifications - Section Ii Of The Award Documentation. Suspension Clause: The Procedure For Awarding The Sectoral Procurement Contract Is Initiated Under This Suspensive Clause, In The Sense That The Conclusion Of The Sectoral Procurement Contract Is Conditional On Obtaining/Approving The Funds Necessary For This Acquisition, The Signing Of The Contract Being Possible Only In The Situation In Which The Provisions Relating To The Commitment Of Expenses From The Budgets That Fall Under The Scope Of Public Finance Legislation Are Respected. Considering The Provisions Of Law No. 99/2016 On Sectoral Public Procurement And H.G. No. 394/2016, With Subsequent Amendments And Additions, The Contracting Entity Specifies That It Will Conclude The Contract With The Bidder Declared The Winner Only To The Extent That The Funds Necessary For The Purchase Will Be Secured By Allocating Budget Credits For This Purpose. If, Regardless Of The Reasons, The Budget Credits Will Not Be Allocated, The Contracting Entity, After Receiving The Notification Regarding The Non-Granting Of Funding, Reserves The Right To Cancel The Awarding Procedure, Provided That There Is No Other Source Of Funding, In Accordance With The Provisions Of Art. 225 Para. (1) Lit. C) The Second Sentence Of Law No. 99/2016 With Subsequent Amendments And Additions, It Being Impossible To Conclude The Public Procurement Contract. Bidders In This Procedure Understand That The Contracting Entity Cannot Be Held Liable For Any Damage In The Event Of Cancellation Of The Award Procedure, Regardless Of Its Nature And Regardless Of Whether The Contracting Entity Was Notified Of The Existence Of Such Damage. Bidders Within This Procedure Accept The Use Of The Above Special Conditions/Suspensive Clause, Assuming Full Responsibility In Relation To Any Damages They May Suffer In The Described Situation. The Maximum Period For Which The Suspensive Clause Operates Is 7 Months From The Date Of Publication Of The Notice Of Participation In Seap, So That, If The Ministerial Order Is Not Issued, The Awarding Procedure Is Cancelled. In This Sense, By Participating In This Procedure, The Bidders Acquire And Agree With The Provisions Of The Suspensive Clause, In Their Entirety.
