1. The Subject Of The Contract Is The Delivery, Implementation And Launch Of An Integrated It And Cybersecurity Infrastructure For The Ordering Party, Including In Particular: Server Infrastructure For Cluster Operation, Disk Array, Network Devices, Nas File Server For Backup, Central Log Collection And Analysis System, Ups Emergency Power Supplies, As Well As The Necessary Software, Licenses, Accessories, Assembly Elements And Cabling, Along With Configuration, Integration, Tests, Post-Implementation Documentation And Training Administrators And Users.2. The Detailed Material Scope, Technical, Functional, Warranty And Service Requirements Are Determined By: 1) The Contractors Offer, 2) Specification Of The Order Terms, 3) Description Of The Subject Of The Order. These Documents Constitute An Integral Part Of The Contract.3. The Ordering Party Informs That Any Indication In Other Documents Regarding The Description Of The Subject Of The Order Of A Trademark, Patent, Own Name Or Other Terms Within The Meaning Of Art. 99 Section 4 Of The Public Procurement Law Does Not Constitute A Requirement To Use This Material Or Device (Indicated By Its Name), But Only Such Indications Specify The Quality And Technological Expectations Of The Ordering Party. For The Avoidance Of Doubt, The Ordering Party Informs That It Allows The Use Of An Equivalent Solution And Pursuant To Art. 99 Section 6 Of The Public Procurement Act Specifies The Following Criterion For Assessing Equivalence, Which Applies To All Materials (Products) And Devices Specified In The Entire Design Documentation And Other Documents Describing The Subject Of The Contract, Namely, The Condition For Using An Equivalent Material Or Device Is To Meet All Of The Following Requirements: - The Material (Alternatively, The Product) Or Equivalent Device Must Ensure The Achievement Of The Same Technological, Performance And Functional Level Assumed In The Design Documentation, Technical Specifications For The Execution And Acceptance Of Construction Works, - The Equivalent Material Or Device Must Ensure That Technical Parameters Are Not Worse Than Those Assumed In The Design Documentation, Technical Specifications For The Execution And Acceptance Of Construction Works, - Equivalent Materials And Devices Must Be Approved For Trading And Use In Accordance With Applicable Regulations, - The Contractor Who Offers Equivalent Products And Devices Requiring Changes To The Decisions Taken, Is Obliged To Obtain The Required Decisions At His Own Efforts And At His Own Expense, While Guaranteeing The Execution Of The Order Within The Time Specified In The Swz, - The Contractor Is Obliged To Demonstrate The Equivalence Of The Materials Or Devices Used.
