1. The Subject Of The Order Is The Modernization Of The Public Playground At The Public Kindergarten In Nieborowice, At Ul. Główna 50, Plot Registration Number 934/97, Rev. Nieborowice, Pilchowice Commune, Gliwice Poviat. 2. Other Provisions Regarding The Subject Of The Order: 1) A Detailed Description Of The Subject Of The Contract And The Scope Of Works To Be Performed Are Specified In The Description Of The Subject Of The Order (Appendix No. 1 To The Swz) And The Design Documentation (Appendix No. 2 To The Swz) Including: Land Development Design, Architectural And Construction Design, Executive Design, Technical Specifications For The Execution And Acceptance Of Construction Works (Stwiorb), Bill Of Quantities. In The Event Of Discrepancies In The Technical Documentation, The Provisions According To The Following Hierarchy Of Documents Are Binding: A) Construction Design; B) Detailed Design C) Stwiorbd) Bill Of Quantities; Due To The Fact That The Contractors Remuneration Is A Lump Sum, When Pricing The Offer, The Contractor Should Rely On The Scope Indicated In The Design Documentation. The Bill Of Quantities Is Of An Auxiliary Nature. The Occurrence Of Works Not Included In The Bill Of Quantities During The Execution Of The Order Or In The Event Of Works Occurring In A Larger Quantity Than In Any Item Of The Bill Of Quantities Will Not Entitle The Contractor To Demand Additional Remuneration, And The Contractor Will Perform The Works Under Standard Contractual Risk - If These Works Were Included In The Design Documentation Or Swz. The Contractor Is Obliged To Carefully Check The Quantity Of Works Against The Design Documentation And Swz. Any Lack Of Necessary Works Resulting From The Design Documentation Or Swz In The Bill Of Quantities Does Not Release The Contractor From The Obligation To Perform Them At The Contractual Price. Jana Długosza 15/4, 44-100 Gliwice.2) The Order May Be Applied For By Contractors Whose Knowledge And Experience Will Allow For The Proper Execution Of The Order;3) The Order May Be Applied For By Contractors Whose Technical Potential Will Allow For The Correct Execution Of The Order, Specified In The Subject And Scope Of The Task;4) The Contractor, On Its Own And At Its Own Expense, Ensures: A) Storage Of All Materials Needed To Complete The Order, B) Delivery Of All Materials Needed To Complete The Order To The Place Indicated By The Ordering Party, C) Removal And Possible Disposal Of Materials Generated During The Execution Of The Order, D) Operation Of Equipment Needed For The Execution Of The Order;3. As Part Of The Remuneration, During The Warranty And Guarantee Period, The Contractor Is Responsible For The Proper Technical Condition Of The Playground Equipment - Including Carrying Out Necessary Repairs, Maintenance And Services In Accordance With The Guidelines Included In The Equipment Manual.
