On The Basis Of Art. 164 Zpuo In The System Of Preschool And School Education, Students Are Provided For Free Use Of Knowledge Books, Textbooks And Study Sets, Which Are Chosen By The Teachers Teaching The Relevant Subject, After Agreement With The Public Council. By Order No. Rd09-1398/30.3.2026 Of The Minister Of Education And Science, Lists Of Knowledge Books, Textbooks And Study Sets That Can Be Used In The Preschool And School Education System During The 2026/2027 School Year Have Been Approved. The Latter Must Meet The Requirements Of Chapter Seven Of The Preschool And School Education Act, Ordinance No. 6 Of 30.11.2015. For Reference Books, Textbooks And Study Aids And Pms No. 79/13.04.2016. Knowledge Books, Textbooks And Teaching Aids Are Subject To Copyright Within The Meaning Of Article 3, Paragraph 2, Item 3 Of The Zapsp. According To Art. 18, Para. 1 Of The Same Law, The Author Has The Exclusive Right To Use The Work Created By Him And To Authorize Its Use By Other Persons. Since The Specified Textbooks, Study Sets And Reference Books Are The Subject Of Creative Activity, The Only Possible Contractors Of The Public Order Are The Relevant Publishing Houses That Own The Copyrights On Them. Therefore, A Public Procurement Should Be Held In Accordance With Art. 182, Para. 1, Cf. Art. 79, Paragraph 1, Item 3 Of The Labor Code, Namely Direct Negotiation.
