The Offered Products, As Well As The Tools Provided For Conducting Procedures, Have Appropriate Documents Valid For The Procedure In Question And Can Be Used In The Health Service In Accordance With The Act For Products Qualified As Medical Devices In Accordance With The Act Of April 7, 2022. On Medical Devices (Journal Of Laws Of 2024, Item 1620, As Amended). The Contractor Also Declares That The Offered Products Qualify As Medical Devices, In Accordance With The Act Of April 7, 2022. On Medical Devices, Have Been Placed On The Market And Used In Poland, In Accordance With The Provisions Of This Act And Related Acts. A Detailed Description Of The Subject Of The Order, Assortment And Estimated Quantities Are Given In The Assortment And Price Form Constituting Annex No. 2 To The Swz. Justification For Not Dividing The Order Into Parts: The Ordering Party Does Not Divide The Order Into Parts Due To The Specificity Of The Subject Of The Order, Which Includes The Successive Delivery Of Implants And Accessories For Arthroscopic Procedures Along With Lending/Providing Access To The Instruments Necessary To Perform These Treatments. Individual Elements Of The Assortment And Instruments Create A Functional, Technical And Organizational Whole. Their Division Between Different Contractors Could Result In The Risk Of Product Incompatibility With The Instruments, Difficulties In Determining Responsibility For The Proper Operation Of The Set, Service Problems And Disruptions In The Continuity Of Arthroscopic Procedures. Fulfillment Of The Order By One Contractor Will Provide The Ordering Party With Uniform Rules For Deliveries, Lending Of Instruments, Service, Training And Responsibility For The Proper Implementation Of The Contract. The Lack Of Division Of The Order Into Parts Is Therefore Justified By Medical, Technical And Organizational Reasons And The Need To Ensure The Safety And Continuity Of Providing Health Services. At The Same Time, The Ordering Party Describes The Subject Of The Order In A Way That Enables The Participation Of Contractors Operating On The Market For The Supply Of Implants, Accessories And Instruments For Arthroscopic Procedures.
