Tenders Are Invited For Drug Delivery

1. The Subject Of This Order Are Medicines Approved By The Minister Of Health For Use In The Territory Of The Republic Of Poland, In The Range And Quantities Specified In The Offer Form (Appendix No. 1 To The Swz). 2. The (Gross) Price Of Medicines Offered By The Contractor Cannot Be Higher Than The Prices Of Reimbursed Medicines Presented In The Notice Of The Minister Of Health On The List Of Reimbursed Medicines, Foodstuffs For Particular Nutritional Uses And Medical Devices Referred To In Section 4 Point 5 Of This Chapter. 3. The Contractor Is Required To Submit An Offer For Medicines Included In The Current List Of Reimbursed Medicines, Foodstuffs For Particular Nutritional Uses And Medical Devices Referred To In Section 4 Point 5 Of This Chapter And Non-Reimbursed Medicines. 4. Medicinal Products (Drugs) Covered By The Subject Of This Public Procurement Must Have The Appropriate Authorization: 1) For Marketing Issued By The Minister Of Health, In Accordance With The Provisions Of The Act Of September 6, 2001, Pharmaceutical Law (Journal Of Laws Of 2024, Item 686, As Amended) - Does Not Apply To Medicinal Products Imported As A Destination Or Should Be Registered In The Community Register Of Human Medicinal Products Authorized For Marketing; 2) The Act Of April 7, 2022 On Medical Devices (Journal Of Laws Of 2024, Item 1620); 3) Act Of 25 August 2006 On Food And Nutrition Safety (Journal Of Laws Of 2023, Item 1448); 4) In Accordance With The Regulation Of The Minister Of Health Of September 16, 2010 On Foodstuffs For Particular Nutritional Uses (Journal Of Laws Of 2015, No. 1026) - If Applicable; Urz. Min. Zdr. 2026.19). 6) The Contractor Declares That The Medicines Covered By This Contract Have All The Necessary Certificates / Approvals / Of The Authorities Authorized To Issue Them And Are Admitted To Marketing In Poland In Accordance With Applicable Regulations. 7) Together With The Subject Of The Order, The Contractor Is Obliged To Provide The Following To The Necessary Extent: - Leaflets In Polish.5. The Contractor May Only Offer Medicinal Products That Are Entered In The Register Of Medicinal Products Authorized For Marketing In The Territory Of The Republic Of Poland, In Accordance With The Currently Applicable Legal Status. 6. If A Trademark Appears Or Is Indicated In The Description Of The Subject Of This Order, It Should Be Assumed That The Ordering Party, By Indicating It, Allows The Submission Of Equivalent Offers With Parameters And Quality Standards Not Worse Than Those Described By Mentioning The Trademarks. 7. By Equivalent Products, The Ordering Party Understands Medicinal Products With Identical Composition, Application, Indications And Contraindications, Quality, Action, Shelf Life And Storage Conditions To Those Indicated In The Offer Form.8.
