The Subject Of The Order Is The Purchase Of A Brand New Special Vehicle - A Garbage Truck. A Detailed Description Of The Subject Of The Order Is Included In The Technical Specification (Appendix No. A To The Swz). The Technical Specification Contains The Minimum Requirements That The Offered Subject Of The Contract Must Meet. 2. The Scope Of Deliveries And The Rules For Its Performance Are Specified In The Contract Template (Appendix No. 4 To The Swz).3. The Subject Of The Order Must Be Free From Physical And Legal Defects, Brand New (Year Of Production 2026), Not Previously Used By Third Parties, Not Used For Demonstration Purposes. The Subject Of The Order Must Be Complete And Upon Delivery Ready For Operation As Intended.4. On The Day Of Delivery Of The Vehicle, The Seller Will Provide The Buyer With: 1/ Operating Instructions And A Spare Parts Catalog In Electronic And Paper Versions In Polish, 2/ Schematic Diagrams Of The Electrical, Hydraulic And Pneumatic Installations In Electronic And Paper Versions, 3/ An Inspection Book Of The Technical Device/Hydraulic Boom/ With A Valid Udt Examination, If Required By Applicable Regulations, 4/ A Set Of Documents Necessary For Registration Of The Vehicle, 5/ An Approval Certificate Or A Certificate Of Individual Admission To Traffic,6/ Third Party Liability Insurance Of The Vehicle.5. The Ordering Party Reserves The Right To Inspect The Vehicle Before Concluding The Contract.6. Whenever In The Swz Or In The Annexes To The Swz The Subject Of The Contract Is Described With An Indication Of Trademarks, Patents Or Origin, Source Or Specific Process That Characterizes The Products Or Services Provided By A Specific Contractor As Well As Standards, European Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems, It Means That The Ordering Party Cannot Describe The Subject Of The Contract In A Sufficiently Precise And Understandable Way And It Is Assumed That Such Indications Are Accompanied By The Words Or Equivalent. Any Of The Above The Indications Were Cited To Specify The Parameters And Technical, Operational, Functional And Quality Requirements Of The Subject Of The Order. The Contractor Who Refers To Solutions Equivalent To Those Described By The Ordering Party Is Obliged To Demonstrate That The Materials And Devices/Products Offered By Him Meet The Requirements Specified By The Ordering Party At A Level Not Lower Than That Indicated In The Description Of The Subject Of The Order.7. The Offered Vehicle And Bodywork Cannot Be Manufactured In Countries Other Than Member States Of The European Union And Other Than Countries That Are Parties To The Agreement On Government Procurement Of The World Trade Organization Or Parties To Other International Agreements Guaranteeing Access To The Public Procurement Market On The Basis Of Reciprocity And Equality
