1) The Subject Of This Order Is The Purchase And Delivery Of A Brand New Bus Manufactured No Earlier Than 2025 With At Least Number Of Seats 18 People + Driver, Orange, With Specialized Equipment (Adaptation For The Transport Of Disabled People) In Accordance With The Requirements Of The Ordering Party Specified In This Specification Of Terms Of Order, I.E.: • The Bus Must Meet The Technical Conditions Specified In The Legal Regulations For School Buses In Force In Poland, Including In Particular: The Requirements Specified In The Act Of June 20, 1997, Road Traffic Law (Journal Of Laws Of 2023, Item 1047, As Amended). Amended) And The Regulation Of The Minister Of Infrastructure Of December 31, 2002 On The Technical Conditions Of Vehicles And Their Necessary Equipment (Journal Of Laws Of 2016, Item 2022, As Amended). • As Part Of The Delivery, The Contractor Will Provide Training In The Operation Of The Subject Of This Order Along With Instructions For 2 (Two) Persons Indicated By The Ordering Party. The Training Will Take Place At The Ordering Partys Premises On The Day Of Acceptance.• The Bus Must Be Complete, Free From Design, Material, Workmanship And Legal Defects.• The Ordering Partys Minimum Requirements For The Vehicle And The Detailed Scope Of Delivery And Obligations Of The Contractor Are Specified In The Draft Contract Constituting Annex No. 7 And The Description Of The Subject Of The Order Constituting Annex No. 5. Wherever The Subject Of The Order Is Described By Reference To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Act, The Ordering Party Allows Solutions Equivalent To Those Described, And Such A Reference Is Accompanied By The Words Or Equivalent.2) If The Description Of The Subject Of The Contract Refers To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Act, And The Offered Supplies Do Not Comply With The Standards, Technical Assessments, Technical Specifications And Technical Reference Systems To Which The Description Of The Subject Of The Order Refers, The Ordering Party Will Not Reject The Offer Provided That The Contractor Proves That The Proposed Solutions Equally Meet The Requirements Specified In The Description Of The Subject Of The Order.3) If The Description Of The Subject Of The Order Refers To The Performance Or Functionality Requirements Referred To In Art. 101 Section 1 Point 1 Of The Act, The Ordering Party Will Not Reject An Offer Compliant With The Polish Standard Transposing A European Standard, Standards Of Other Member States Of The European Economic Area Transposing European Standards, With A European Technical Assessment, With A Common Technical Specification, With An International Standard Or With A Technical Reference System Established By A European Standardization Body, If These Standards,
