The Object Of The Public Procurement Is A Service Within The Meaning Of Art. 3, Para. 1, Item 3 Of The Public Procurement Act (Ppa). The Subject Of The Public Procurement Is The Provision Of Insurance Services, Distributed According To The Following Specific Positions: Separate Item No. 1 Professional Liability Insurance Separate Position No. 2 Car Insurance Separate Position No. 3 Movable Property Insurance Medical Equipment The Estimated Value Of The Present Public Order For The Provision Of Insurance Services Is Eur 240,000.00 (Two Hundred And Forty Thousand Euros) Excluding Vat, Including Vat Tax, Divided Into Three Separate Items (Op), As Follows: Op No. 1: Professional Liability Insurance - 208,811.20 Euros (Two Hundred And Eight Thousand Eight Hundred And Eleven Euros And Twenty Euro Cents) Excluding Vat, Including Vat Tax; Op No. 2: Automotive Insurance - 25,053.30 Euros (Twenty-Five Thousand And Fifty-Three Euros And Thirty Euro Cents) Excluding Vat, Including Vat Tax. Op No. 3: Movable Property Insurance Medical Equipment - 6,135.50 Euros (Six Thousand One Hundred And Thirty-Five Euros And Fifty Euro Cents) Without Vat Included, With Tax Under The Social Security Act Included. According To Art. 21, Para. 6 Of The Zop, The Contracting Authority Has The Right To Award Individual Items In The Order Valid For The Individual Value Of Each Of Them, Provided That The Value Of The Respective Individual Item Does Not Exceed €79,998.77 For Supplies And Services And The Total Estimated Value Of The Individual Items Awarded In This Way Does Not Exceed 20 Percent Of The Total Value Of The Order. In These Cases, Regardless Of The Residual Value Of The Order, It Is Awarded In The Order Applicable To The Total Estimated Value Of The Entire Order. Taking Into Account The Above, The Estimated Value Of Separate Item No. 1 Professional Liability Insurance Which The Contracting Authority Intends To Assign Under The Ppa Is In The Amount Of Eur 208,811.20 Excluding Vat, Which Represents 87% Of The Total Value Of The Order. The Estimated Value Of Separate Item No. 2 And Separate Item No. 3 - The Arithmetical Sum Is 31,188.80 Euros (Thirty One Thousand One Hundred And Eighty Eight Euros And Eighty Euro Cents) Excluding Vat, Including Vat Tax, The Same Represents 13% Of The Total Value Of The Order And Falls Within The Scope Of Art. 20, Para. 4, Item 3 Of The Civil Code. In View Of The Above And On The Basis Of Art. 21, Para. 6 Of The Zop, Separate Positions No. 2 And No. 3 Will Be Assigned In Accordance With Art. 20, Para. 4, Item 3 Of The Civil Code, Namely By Direct Award. Pursuant To Art. 21, Para. 6 Of The Zop, The Residual Value (Being The Estimated Value Of Op No. 1), Given Its Size And The Total Value Of The Order, Is Assigned By Conducting An Open Procedure, Assigned In Accordance With Art. 18, Para. 1, Item 1 Of The Civil Code.
