Mechanical Shovels, Excavators And Shovel Loaders, And Mining Machinery – Purchase And Delivery Of A New Backhoe Loader For The Municipal Utilities Plant In Zakrętym. 1. The Subject Of The Order Is The Purchase And Delivery Of A Brand New Backhoe Loader That Meets The Technical And Operational Requirements Indicated In The Description Of The Subject Of The Order. 2. A Detailed Description Of The Subject Of The Order, Including The Minimum Requirements, Is Included In Annex No. 2 To The Swz - Description Of The Subject Of The Order. It Is Also A Description Of The Offered Backhoe Loader, Because In The Offered Technical Parameters Column, The Contractor Should Refer To Each Of The Minimum Requirements Set By The Ordering Party In The Minimum Requirements Column. The Contractor Also Specifies The Model/Type And Manufacturer. The Machine Offered By The Contractor Must Meet The Requirements Set Out In This Annex In The Minimum Requirements Column And Must Be Delivered Under The Conditions Specified In The Swz. 3. In Order To Confirm Compliance Of The Offered Supplies With The Requirements, Features Or Criteria Specified In The Description Of The Subject Of The Order Or Requirements Related To The Implementation Of The Order, The Ordering Party Requires The Contractor Applying For This Order To Submit The Following Evidence Together With The Offer: - Description Of The Offered Backhoe Loader, Including The Manufacturer, Model/Type - In Accordance With Annex No. 2 To The Swz. -Statements Of The Manufacturer Or The Manufacturers Authorized Representative Confirming That The Service Of The Offered Backhoe Loader Will Be Carried Out Directly By The Manufacturer And/Or In Cooperation With The Manufacturers Authorized Representative In Poland At A Distance Of Up To 100 Km From The Ordering Partys Headquarters. 4. Subject Documents Referred To In Section 3 Must Be Submitted In Polish. Documents In A Foreign Language Should Be Submitted With A Translation Into Polish, Certified By The Contractor. The Ordering Party Allows For The Submission Or Supplementation Of The Evidence In Question. 5. The Terms And Period Of The Warranty Are Specified In Appendix No. 2 To The Swz. The Warranty Period Is 2 Years. 6. If The Swz, Announcements Related To The Procedure, Or The Detailed Description Of The Subject Of The Contract Specify The Subject Of The Contract By Indicating Trademarks, Patents Or The Origin, Source Or Specific Process That Characterizes The Products Or Services Provided By A Specific Contractor, This Is Only To Determine The Technical Features Or Properties Of Specific Equipment, Devices, Materials And Software That Should Be Used To Perform The Subject Of The Contract. The Ordering Party Allows The Use Of Machinery, Equipment, Devices And Equivalent Materials In Such Cases, In Accordance With Art. 99 Section 5 Of The Act. 7. The Ordering Party Provides For The Possibility Of Making Changes To The Contract On The Terms Specified In The Draft Contract Constituting Annex No. 1 To The Swz. 8. The Ordering Party Envisages The Use Of The So-Called Reverse Procedure Referred To In Art. 139 Of The Public Procurement Law, I.E.
