Although Ca Repeatedly Notified The Contractor About The Defective Performance Of The Contract, The Latter Did Not Comply With His Contractual Obligations To The Terms And Conditions Stipulated In The Contract, Which Is Why The Ca Decided To Terminate, Due To The Non-Fulfillment Of The Contractual Conditions, Which Were Executed In A Percentage Of Approximately 70%. It Is Deemed That The Contractor Has Inspected And Examined The Site And Its Surroundings, Analyzed The Data And That He Has Educated Himself, Before Submitting The Offer, On All Relevant Aspects, Such As, But Not Limited To, The Form And Nature Of The Site, The Extent And Nature Of The Works, The Materials Necessary For The Execution Of The Works, Access Ways To The Site, Utilities And In General Obtained All Information Regarding The Risks. Considering That The Contractor Is Deemed To Have Established His Prices Based On His Own Calculations, Operations And Estimates, The Contractor Will, Without Payment Of Any Additional Cost, Comply With Any Obligation And Perform Any Work Provided For In The Contract.
