A Detailed Description Of The Subject Of The Order Is Included In Annex No. 8 To The Swz (Technical Documentation).3. If The Description Of The Subject Of The Order Includes The Manufacturers Name, Proper Names, Trademarks, Patents Or The Origin Of The Materials Used To Perform The Order, It Is Possible To Use Equivalent Materials. This Means That The Devices/Solutions/Software Intended By The Contractor To Be Used At The Stage Of Order Execution Should Meet At Least The Parameters Specified In The Documentation And Should Not Be Worse Than Its Assumptions. The Ordering Party Allows Any Market Equivalents With Parameters Equal Or Better Than Those Indicated. The Burden Of Proving That The Device/Solution/Software Is Equivalent To The Requirement Specified By The Ordering Party Rests With The Contractor. In Such A Case, The Contractor Must Submit Appropriate Documents Describing The Technical Parameters, Certificates Required By Law And Other Documents Authorizing The Use Of The Given Device/Solution/Software And Making It Possible To Clearly State That They Are Actually Equivalent Or Better.
