The Purpose Of The Application Of This Procedure Is To Conclude The Contract For The Provision Of Services, For The Elaboration Of The Technical-Economic Documentation For The Feasibility Study Phase And The Financing Application, For The Investment Objective Reconnecting And Restoring The Meanders Of The Old Jijia Water Course And Restoring The Riparian And Flowing Water Ecosystems. Brief Description Of The Proposed Investment Objective, From A Technical And Functional Point Of View: - Destination And Functions O Restoring The Lateral Connectivity Of Water Bodies; O Restoration Of Degraded Wetlands And Aquatic Habitats; O Restoring The Groundwater Level And Reducing Groundwater Flow; O Improving Water Quality; O Reducing The Clogging Phenomenon By Planting Trees And Shrubs. - Characteristics, Parameters And Specific Technical Data, Expected The Project Will Ecologically Improve The State Of The Old Jijia Watercourse Over A Length Of 56.50 Km, Respectively: A Development/Unclogging Of The Old Bed Of The Jija River Over A Length Of 56.6 Km; A Vegetative Consolidation Of Banks; A Sediment Retention Traps; Planting Riparian Vegetation, Removing Invasive Species; The Proposed Works Will Generally Be Carried Out In The Minor River Bed And On The Banks. Suspensive Clause The Procedure For Awarding The Public Procurement Contract Is Initiated Under The Scope Of This Suspensive Clause, In The Sense That The Conclusion Of The Public Procurement Contract Is Conditional On The Allocation Of Commitment Credits/Budgetary Credits For This Purpose, The Signing Of The Contract Being Done In Compliance With The Provisions Relating To The Commitment Of Expenses From Budgets That Fall Under The Scope Of Public Finance Legislation. Considering The Provisions Of Law 98/2016 On Public Procurement And H.G. No. 395/2016, With Subsequent Amendments And Additions, The Contracting Authority Specifies That It Will Conclude The Contract With The Bidder Declared The Winner Only To The Extent That The Funds Necessary For The Purchase Will Be Secured By The Allocation Of Commitment Credits/Budgetary Credits For This Purpose. If, Regardless Of The Reasons, The Commitment Credits/Budgetary Credits Will Not Be Allocated, For A Period Of 6 (Six) Months From The Date Of Approval Of The Procedure Report And/Or From The Date Of Final Resolution Of Any Appeals, The Awarding Procedure Will Be Canceled By Law, Provided That There Is No Other Source Of Funding, In Accordance With The Provisions Of Art. 212 Para. (1) Lit. C) Sentence 2 Of Law 98/2016 With Subsequent Amendments And Additions, It Being Impossible To Conclude The Public Procurement Contract.
