4.1 The Subject Of The Order Is The Supply Of Server Hardware And Software. 4.2 The Scope Of The Subject Of The Order Is As Follows: The Order Is Divided Into 10 Parts: Part 1 - Delivery Of A Server Ups - Server Ups 1 Piece, 4.4 The Ordering Party Requires That The Offered Service, Including All Ict Products, Ict Services And Ict Processes Used To Complete The Order, Both As Main Elements And Components, Elements Of The Service Provision Environment Or Accompanying Solutions, Does Not Included:• Ict Products, Ict Services Or Ict Processes Indicated In The Recommendation Referred To In Art. 33 Section 4 Of The Act Of July 5, 2018 On The National Cybersecurity System, Stating Their Negative Impact On The Fundamental Interest Of State Security; • An Ict Product Whose Type Was Specified In The Decision To Recognize The Supplier As A High-Risk Supplier Referred To In Art. 67B Section 15 Of The Act Of 5 July 2018 On The National Cybersecurity System, Nor The Ict Services Or Ict Processes Specified In This Decision. Failure To Meet The Above Requirement Results In Rejection Of The Offer Pursuant To Art. 226 Section 1 Point 17 Or Point 19 Of The Public Procurement Law (Hereinafter Also Referred To As Pzp). The Contractor Is Obliged To Perform The Order Using Ict Products, Ict Services And Ict Processes Corresponding To The Content Of The Offer, Order Documents And The Provisions Of The Contract. Replacement Of The Manufacturer, Technology Supplier, Model, Version, Service Environment Or Ict Process During The Performance Of The Contract May Only Occur In Legally Permissible Cases And In Compliance With The Requirements Arising From Art. 454 And Art. 455 Of The Public Procurement Law, As Well As In Accordance With The Provisions Of The Contract Specifying The Permissible Grounds And Conditions For The Change.
