1. The Subject Of The Order Is The Delivery, Assembly And Commissioning Of A Colposcope, Hereinafter Referred To As Equipment.2. The Description Of The Subject Of The Order Is Included In The Required Parameters Form (Appendix 2 To The Swz, Hereinafter Also Referred To As Fpw), This Form Must Be Submitted Together With The Offer Form (Appendix 1 To The Swz, Hereinafter Also Referred To As Fo).3. The Ordering Party Requires That The Offered Equipment Constitutes A Medical Device - Within The Meaning Of The Act Of April 7, 2022 On Medical Devices (Consolidated Text: Journal Of Laws Of 2024, Item 1620, As Amended, Hereinafter Referred To As: Uowm), Placed On The Market And Used In The Territory Of The Republic Of Poland In Accordance With Applicable Regulations.4. The Ordering Party Requires That The Contractor, When Implementing The Subject Of The Contract, Act In Accordance With The Do No Serious Harm (Dnsh) Principle, Specified In Art. 17 Of Regulation (Eu) 2020/852, In Particular:• Ensured That The Devices Meet Energy Efficiency Requirements,• Ensured The Possession Of The Required Environmental Certificates,• Ensured The Minimization Of Emissions And Environmental Impacts,• Collected And Managed Waste Generated During Delivery, Installation Or Servicing In Accordance With The Waste Management Hierarchy (Prevention, Reuse, Recycling, Recovery, Disposal),• Transport And Installation Of The Devices Were Carried Out In A Manner Minimizing Environmental Impact.5. The Ordering Party Does Not Allow The Submission Of Partial Offers In A Given Procedure. The Order Consists Of 1 Task. The Ordering Party Does Not Divide The Order Into Parts, Because The Division Will Not Be Appropriate Due To The Subject Of The Order Which Concerns The Purchase Of One Device. Additionally, The Need To Coordinate The Activities Of Different Contractors Implementing Individual Parts Of The Order (Delivery And Assembly Separately) Could Seriously Jeopardize The Proper And Timely Execution Of The Order. Dividing The Subject Of The Contract Into Smaller Parts Would Also Be Pointless. Such Action Could Result In Unfavorable Consequences For The Ordering Party, E.G. An Increase In The Offered Prices Or The Inability To Resolve The Proceedings Due To The Fact That Submitting Offers For Such Small Parts Of The Order Could Prove Unprofitable For The Contractor. The Device Constitutes An Integral Whole, And Dividing It Into Parts (E.G. Separate Delivery, Separate Assembly) Would Prevent Its Proper Operation And Exclude The Warranty Liability Of One Contractor And Increase Costs6. The Ordering Party Does Not Allow The Submission Of Variant Offers.
