The Subject Of The Order Is The Supply Of Computer Equipment For The Municipality Of Tychy, Divided Into The Following Tasks: 1) Task No. 1 - 14 Laptops (Including Software, Accessories, Warranty And Service Support), 2) Task No. 2 - 16 Laptops (Including Software, Accessories, Warranty And Service Support), 3) Task No. 3 - Desktop Computers (Including Software, Accessories, Warranty And Service Support),4) Task No. 4 - Server (Including Software, Equipment, Warranty And Service Support). A Detailed Description Of The Subject Of The Order Is Included In Annex No. 4, 4A, 4B And 4C To The Swz. Amendments To The Agreement For Task No. 1: § 13 Draft Provisions Of The Contract1. The Parties Provide For The Possibility Of Making Changes To The Provisions Of The Concluded Agreement In Relation To The Content Of The Offer On The Basis Of Which The Contractor Was Selected, In Accordance With Article 455(1)(1) Of The Public Procurement Law (Journal Of Laws Of 2024, Item 1320, As Amended) In The Following Cases: 1) Due To The Impossibility Of Implementing The Subject Of The Agreement Within The Assumed Deadline Due To Force Majeure Or A Random External Event, The Effects Of Which Cannot Be Predicted, As Well As In The Event Of The Need To Take Actions To Limit The Effects Of Force Majeure. For The Purposes Of The Implementation Of The Agreement, Force Majeure Means An Event Or Combination Of Events Or Circumstances Beyond The Control Of The Parties, Which Substantially Hinder Or Prevent The Performance Of The Obligations Of A Given Party Under The Agreement, And Which The Party Could Not Predict Or Prevent Or Overcome By Acting With Due Diligence Or Other Circumstances Beyond The Control Of The Parties; 2) In The Event Of The Contractors Inability To Deliver Equipment Or Its Components Due To Lack Of Availability On The Market. (E.G. Termination Of Production, Withdrawal From Production Or Sales, Suspension Of Production), Which Will Be Confirmed By Its Manufacturer. It Is Permissible For The Contractor To Provide Equipment With Technical Parameters Not Worse Than Those Specified In The Opz. The Initiator Of This Change May Only Be The Contractor, Who Is Obliged To Submit To The Ordering Party Appropriate Documents Regarding The Compliance Of The New Equipment With The Requirements Specified By The Ordering Party, And In Such A Case The Contractors Remuneration In Relation To The New Equipment May Be Provided To The Remuneration Specified In The Contract Will Not Be Increased; 3) There Will Be Actions Of Third Parties That Prevent The Execution Of The Subject Of The Agreement On Time Or Other Events That May Negatively Affect The Deadline And Quality Of The Subject Of The Agreement, Including Events Of A Legal, Economic, Organizational Or Technical Nature That May Affect The Method Of Implementation Of The Agreement, The Scope Of The Obligations Of The Parties Or The Deadline For The Implementation Of The Agreement; 5) It Is Necessary To Change The Method O
