1. The Subject Of These Proceedings Is The Supply Of Medicines And Medical Devices For The Needs Of The Municipal Hospital In Rabka – Zdrój Sp. Z O. O., The Detailed Description Of Which, As Well As The Quantitative And Assortment Scope, Is Specified In The Assortment And Price Form, Constituting Annex No. 1 To The Swz. 2. The Description Contained In Annex No. 1 To The Swz Should Be Read Together With Any Changes To The Content Of The Swz, E.G. Resulting From Answers To Contractors Inquiries. The Full Partial Offer Must Include All Completed Items Listed In Annex 1 To Swz.3. The Quantities Given In Annex 1 To The Swz Should Be Treated As Estimated Needs During The Duration Of The Order, Used To Determine The Offer Price, I.E. Determine The Estimated Remuneration Of The Contractor. The Ordering Party Reserves The Right To Resign From Purchasing Part Of The Product Range, On The Terms Specified In The Draft Contractual Provisions. The Purchase Of Each Product Will Depend On The Actual Needs Of The Ordering Party (Current Condition Of Patients And Medical Justification). The Demand For Individual Product Items Is Strictly Dependent On The Occupancy Of Individual Departments Of The Hospital And The Type Of Patients. 4. The Ordering Party Reserves The Right To Change The Quantity Of The Ordered Product Between Individual Items Of The Subject Of The Order In A Given Package.5. Medicinal Products Constituting The Subject Of The Order Should Be Understood As Medicinal Products Within The Meaning Of The Pharmaceutical Law Act Of September 6, 2001. The Offered Medicinal Products Must Be Authorized For Marketing And Use In Poland In Accordance With The Principles Specified In The Pharmaceutical Law.6. Medical Devices That Are The Subject Of The Order Should Be Understood As Medical Devices Within The Meaning Of The Medical Devices Act Of April 7, 2022 On Medical Devices And Regulation (Eu) 2017/745 Of The European Parliament And Of The Council Of April 5, 2017 On Medical Devices. The Offered Medical Devices Must Be Approved For Trading And Use In Poland Under The Terms Specified In The Medical Devices Act.7. The Contractor Offering A Medicinal Product Or Medical Device Included In The List Of Reimbursed Medicines Must Take Into Account The Provisions Of Art. When Calculating The Price. 9 Section 2 Of The Act Of May 12, 2011 On The Reimbursement Of Medicines, Foodstuffs Intended For Particular Nutritional Uses And Medical Devices, Valid As Of The Date Of Submission Of Offers. In Addition, The Clarifications Regarding Art. 9 Section 2 Contained In The Communication Of The Minister Of Health Of March 26, 2012 (Letter Mz-Plr-460-12576-160/Kb/12). The Prices Of The Offered Medicinal Products Included In Lists B And C Of The Minister Of Healths Announcements Cannot Be Higher Than The Financing Limit.
