The Public Contract (Hereafter Also Referred To As Vz) Is Divided Into Separate Parts Awarded In Separate Procedures. - Part Of The Vz Demand Transport Awarded In This Open Procurement Procedure; - Part Vz Provision Of The Platform Incl. The License Is Entered In Accordance With § 18 Paragraph 3 Of The Zzvz As A Small-Scale Public Order (Hereinafter Referred To As Vzmr), Which Is Not Entered In This Open Tender Procedure; The Expected Value Of This Vzmr For 4 Years Of Service Provision Is Czk 1,680,000 Without Vat Subject Of The Public Contract: Provision Of Public Scheduled Transport Services In The Form Of So-Called On-Demand Transport According To § 2 Paragraph 7 Of Act No. 111/1994 Coll., On Road Transport, As Amended (Hereinafter Referred To As The Road Act), In A Defined Area And Within A Specified Time Frame. This Is An Agreement On Public Services In Passenger Transport Within The Meaning Of Act No. 194/2010 Coll., On Public Services In Passenger Transport And On The Amendment Of Other Laws, As Amended (Hereinafter Referred To As The Paa) And Regulation Of The European Parliament And Council (Ec) No. 1370/2007 Of October 23, 2007 On Public Services In Passenger Transport By Rail And Road And On The Repeal Of Council Regulation (Eec) No. 1191/69 And No. 1107/70, As Amended (Hereinafter Referred To As The Regulation). On The Suppliers Side, The Business Risk Associated With The Amount Of Revenue From Fares For The Provision Of Public Services In The Transport Of Passengers Is Excluded, As The Supplier Is Paid Compensation (Price) For The Provision Of On-Demand Transport Services According To The Number Of Days Of Service Provision, Or According To The Number Of Kilometers Over The Limit, Regardless Of The Selected Fare, Which The Supplier, After Deducting The Specified Fees (Especially Bank, Card, Terminal Operator, Payment Gateway, 3Rd Party Payment System, Etc., Hereinafter Referred To As Transaction Fees), Returns The Full Amount To The Contracting Authority. Transport Carried Out By 2 M1 Category Vehicles (Max. 8+1 Persons), Each Vehicle With One Driver (I.E. At Least 2 Drivers In Total). Within 6 Months From The Date Of The Start Of Performance, Demand Transport Must Be Provided By Electric Vehicles, I.E. Both Vehicles Must Be (At The Same Time, In Addition To Meeting Other Specified Conditions) Fully Electric - Driven Exclusively By An Electric Motor. Thus, If The Supplier Does Not Have Two Electric Vehicles Available To Provide On-Demand Transport At The Time Of The Start Of Performance, The Supplier Is Entitled To Provide On-Demand Transport Services For A Specified Initial Transitional Period With Vehicles That Meet The Requirements Of The Contracting Authority, Except For The Requirement For An Electric Motor. A Platform For The Provision Of On-Demand Transport Services (In Particular, A System For Ordering Rides, A Passenger Application, A Driver Application, A Dispatch System) (Hereinafter Referred To As The Platform) Incl. The Relevant License Is Secured By The Client On The Basis Of A Separate Contract Between The Client And The Platform Operator Citya Mobility S.R.O., Ičo: 13975471, Zaoralova 3045/1E, Líšeň, 628 00 Brno (Hereinafter And Above Only Platform Operator). The Contracting Authority Will Provide The Supplier With The Platform Incl. Of The Relevant Applications Is Sublicensed To The Extent Necessary For The Provision Of On-Demand Transport By The Supplier, At A Price Of Czk 1 Excluding Vat/Calendar Month. The Supplier Is Obliged To Enter Into A Specified Distribution Contract With The Platform Operator Regarding The Sale/Distribution Of Tickets To Passengers (For A Model Of The Distribution Contract, See The Tender Documentation Attachment). The Supplier Must Have Been Granted A License To Operate Public Line Transport In The Form Of Demand Transport By The Relevant Transport Authority; The Supplier Is Obliged To Submit The Application For A License To The Relevant Transport Authority Without Undue Delay After The Effective Date Of The Contract On Public Services In The Transport Of Passengers Concluded With The Contracting Authority For The Implementation Of This Public Contract. Technical Annexes Reservation Of Change Of Obligation According To § 100, Paragraph 1 Of The Act: Yes – Change Of The Time Range Of The Provision Of On-Demand Transport Services In Terms Of The Specific Definition Of The Time Period Within The Day And The Definition Of The Days During Which The Supplier Is Obliged To Provide The On-Demand Transport Service, As Well As The Change In The Definition Of The Summer Operation Period, Areas Or Virtual Stops Within The Defined Territory (It Has No Impact On The Estimated Value Of The Public Contract, The Supplier Is Paid Remuneration (Compensation) Based On Daily Flat-Rate Payments, Or For Over-Limit Kilometers, Regardless Of The Setting Of The Period, Area Or The Number/Location Of Virtual Stops), As Well As A Change In The Type Or Price Of The Fare, Or Any Fees/Payments For The Ride (It Has No Impact On The Estimated Value Of The Public Contract, The Supplier Returns Fares Collected By The Contracting Authority After Deducting The Transaction Fees), Inflation Clause From 1.1.2029, And Further Changes To The Platform Settings Without Affecting The Scope Of Provision Of On-Demand Transport Services By The Supplier And The Paid Remuneration (Compensation) (For More Details, See Chapter 18 Zd).
