The Subject Of The Order Is The Supply Of Equipment And Tools Divided Into Tasks: Task 1) Equipment For The Repair Of Mechanical Components Under: European Funds For Silesia 2021-2027 (Fund For Just Transformation). The Description Of The Subject Of The Order Is Included In Annex No. 4 A To Swz. General Requirements1. The Ordering Party Requires That The Subject Of The Order Be Brand New, Of Full Value, Free From Any Defects And Damage, Without Previous Use.2. The Ordering Party Requires That The Subject Of The Order Complies With The Recommendations, Standards And Applicable Technical And Operational Requirements In Force In The Republic Of Poland And The European Union (Ce Declarations). 3. The Contractor Undertakes To Deliver, At His Own Expense, All Elements That Are Part Of The Subject Of The Order, Together With Technical Documentation Attached By The Manufacturer, Warranty Cards And Documents Specifying The Rules For The Provision Of Services During The Warranty Period.4. The Minimum Warranty Period For The Offered Subject Matter Of The Contract Cannot Be Shorter Than 24 Months (If A Shorter Period Is Offered, The Offer Will Be Rejected In Accordance With Article 226(1)(5) Of The Public Procurement Act Because Its Content Will Be Inconsistent With The Terms Of The Contract). The Deadline For Removing Defects Is Up To 14 Days. If The Description Of The Subject Matter Of The Contract Includes References To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Act, The Ordering Party Allows Solutions Equivalent To Those Described. If The Provided Documentation Includes Names Of Manufacturers, Products Or Solutions, Indications Of Trademarks, Patents Or Origin, Source Of Approach Or A Specific Process That Characterizes Products Or Services Provided By A Specific Contractor, The Ordering Party Allows The Offer Of Materials, Devices, Solutions Equivalent In Terms Of Technical, Quality, Utility And Operational Parameters, Provided That They Ensure The Achievement Of Parameters Not Worse (The Same As Those Described In The Swz). Or Better) Than Those Set Out In The Annexes To The Swz. The Ordering Party Informs That The Definition Of The Subject Of The Order Used In The Swz By Indicating Proper Names, Etc. Is Only Intended To Specify The Subject Of The Order. The Ordering Party Requires The Contractor To Present Evidence Of Equivalence In The Offer. The Ordering Party Indicates That The Obligation To Submit In The Offer Solutions Equivalent To Those Described In The Swz And To Demonstrate Equivalence Lies With The Contractor.
