Cargo Handling And Storage Services – Railport Hafen Emmelsum Tender Procedure. 1. The Concession Will Be Granted As Part Of A Leasehold Agreement. The Area Available For The Construction And Operation Of The Railport Is Approximately 4.6 Hectares. The Specific Space Requirements And Thus The Specific Dimensions Of The Future Concession Property As Well As The Route Of The Railway Infrastructure On It Must Be Determined As Part Of The Negotiations. The (Then) Concessionaire Should Be Able To Apply For Or Receive Funding From Public Funds For The Implementation Of The Measure (If Necessary). The Specific Contract Design Will Therefore Depend On, Among Other Things, Be Based On The Requirements Of The Relevant Funding Conditions. Against This Background, The Term Of The Concession Will Cover At Least The Corresponding Funding Period In The Event Of An Application For Grants. 2. The Port Of Emmelsum Must Maintain The Character Of A Public Port As Part Of The Implementation Of The Concession. For This Reason, The (Then) Concessionaire Is Obliged To Operate The Concession Land Provided To It And The Structures And Facilities Located Thereon In A Non-Discriminatory Manner. It Must Also Provide Transshipment Services To Third Parties In A Non-Discriminatory And Transparent Manner. 3. The Leasehold Contract Will Contain The Right And Obligation To Build The Contractually Agreed Development (At Least Surface Paving And Double-Track Railway Infrastructure) Within A Reasonable Period Of Time To Be Negotiated And To Then Operate It Without Discrimination For The Duration Of The Contract Term. 4. As Part Of The Leasehold Agreement, Minimum Requirements Are Set, In Particular For The Financing/Lending Of Deltaport. In Particular, Appropriate Repayments Of The Loans Secured By The Land Charges (For The Construction Of Buildings And Facilities) Are Mandatory. Resale To Closed Funds Or Similar With A Shorter Term Than The Leasehold Contract Is Excluded. 5. Deltaport Sets Minimum Requirements For The Planned Settlement Concept, Compliance With Which The Bidder Must Already Prove As Part Of The Application For Participation. The Minimum Requirements For The Operation Of The Concession Property Are Met If A) A Service Industry Business In Port-Oriented Freight Transport (Forwarding, Transshipment And Storage, Trading And Also Temperature-Controlled Distribution Of Goods) Is Located (Port-Related Settlement), B) Which Carries Out And Generates (Own Or Non-Discriminatory Third Party) Transshipment Via The Port Railway Mode Of Transport As Part Of An Intermodal Network And C) Which Has At Least A Double-Track Railway Infrastructure With A Length Of Approximately 700 M And Operates It For The Aforementioned Purpose. 6.
