1. The Subject Of The Order Is Comprehensive Thermal Modernization Of A Public Building At Ul. Chełmińska 9/Słowackiego 6 In Sztum, Including: Thermal Modernization Of The Facade, Renovation Of The Roof Covering And Replacement Of Gutters, Replacement Of External Window Joinery, Renovation Of External Door Joinery, Replacement Of The Internal Central Heating Installation, As Well As Partial Renovation And Replacement Of Internal Cladding And Partial Replacement Of Electrical Installations.2. The Detailed Scope Of The Subject Matter Of The Contract Is Specified In The Design Documentation, Industry Arrangements And Technical Specifications For The Execution And Acceptance Of Construction Works (Stwiorb) Prepared By The Taika Jan Ciesielski Design Office From Kalisz, The Content Of Which The Contractor Declares That He Is Familiar With. Bills Of Quantities Are Of Auxiliary And Informative Nature.3. All Documents Describing The Subject Of The Contract Should Be Treated As Mutually Complementary And Clarifying In The Sense That If Any Ambiguities Or Ambiguities Are Found, The Contractor Cannot Limit Either The Scope Of Its Obligation Or The Scope Of Due Diligence In The Performance Of Its Obligations Under The Public Procurement Contract.4. The Ordering Party Has Made Every Effort To Ensure That The Description Of The Subject Of The Order Does Not Include Any Trade Name Of The Company, Goods Or Product. The Ordering Party Allows Offering Equivalent Materials And Devices, Provided That They Guarantee The Implementation Of Works In Accordance With The Construction Law And Relevant Standards And Ensure Obtaining Technical Parameters (Equivalence Criteria) Confirming The Equivalence Of Materials And Devices Specified In The Order Description And They Will Be Previously Accepted By The Ordering Party.5. The Subject Of The Order Will Be Carried Out In An Open Facility. The Possibility Of Collision-Free Operation Of The Building During Construction Works Should Be Taken Into Account And Ensured. The Work Carried Out Cannot Have Any Negative Impact On The Operation Of The Clinic In Securing The Space For Communication, With Particular Emphasis On Disabled People. Complete Safety Of People Using The Building And Passers-By Must Be Ensured. The Construction Site Should Be Fenced Off With Particular Care To Prevent Access By Unauthorized Persons. 6. The Ordering Party Declares That The Task Will Be Financed From The Regional Program European Funds For Pomerania 2021-2027 And Will Be Implemented In Accordance With The Conditions Specified Therein. In Connection With The Above, The Parties Declare That They Are Aware That It Is In The Ordering Partys Interest To Complete The Order On Time. If The Contractual Deadline Specified In §3 Of This Contract Is Not Met, The Ordering Party Will Lose The Funding And Damage Will Result. The Contracto
