With A Decision Of December 1, 2020, The Federal Constitutional Court (Bverfg) Declared The Regulation On Electronic Residence Monitoring (Eaü) In The Context Of Executive Supervision To Be Constitutional, But At The Same Time Ordered The Legislature To Empirically Observe The Special Preventive Effects And Technical Framework Conditions Of The Eaü And, If Necessary, Adapt The Legal Regulatory Concept To The Findings Gained (4Th Guiding Principle). According To The Bverfgs Findings, There Is So Far A Lack Of Unequivocal Empirical Evidence That The Eaü Leads To A Reduction In The Risk Of Re-Offending For The Group Of People Covered By Section 68B Paragraph 1 Sentence 1 Number 12, Sentence 3 Stgb. Since The Eaü Is Particularly Intervention-Intensive Compared To The Other Management Supervision Measures, This Justifies “Special Observation And, If Necessary, Improvement Obligations On The Part Of The Legislature.” The Main Aim Of The Research Project Is To Investigate The Special Preventive Effectiveness Of The Eaü. The Bverfgs Requirement Is Also Reflected In The Justification For The Introduction Of Section 68B Paragraph 1 Sentence 1 Number 12, Sentence 3 Stgb. According To This, The Eaü Is Primarily Intended To Have A Special Preventive Effect, In Particular By Enabling Better Monitoring Of Compliance With Stay-Related Instructions In Accordance With Section 68B Paragraph 1 Sentence 1 Numbers 1 And 2 Stgb, But Also Creates An Increased Risk Of Detection In The Event Of A New Serious Crime. The Technical Framework Conditions Should Also Be Examined (Particularly With Regard To Data Collection, Battery Life, Possible Malfunctions Or Signal Interference And Other Technical Features). The Research Goal Presented Should Be Achieved Through Qualitative, Empirical Research. Based On The Findings Of An Earlier Research Project Commissioned By The Bmj(V), Which Dealt With The Practical Implementation Of The Eaü, But Not Its Special Preventive Effects, The Following Methodology Is Available, Which Is Explained In More Detail In The Tender Documents: I.
