1. The Subject Of The Order Is The Renovation And Modernization Of The Facility Of The Municipal Cultural Center In Wołomin At Ul. Marianska 7 As Part Of The Investment Project Entitled Green And Accessible Culture - Modernization Of The Activity Center And The Municipal Cultural Center In Wołomin (Hereinafter Referred To As The Investment).2. The Investment Is Co-Financed By European Funds In The Financial Perspective 2021-2027, Project No. Fema.05.07-Ip.01-03Zd/24 Titled Green And Accessible Culture - Modernization Of The Activity Center And The Municipal Cultural Center In Wołomin.3. As Part Of The Subject Matter Of The Contract, The Contractor Undertakes To: 1) Perform The Investment In Accordance With The Provisions Of This Contract, The Content Of The Specification Of Terms Of Order Constituting Annex No. 3 To This Contract (Hereinafter Also Referred To As: Swz), As Well As In Accordance With The Design Documentation Constituting Annex No. 2 To This Contract, 2) Perform The Scope Of Works Necessary To Complete The Investment, Including Works Not Specified In The Documentation But Necessary To Implement The Subject Matter Of The Contract And The Proper Functioning Of The Facility Of The Municipal Cultural Center In Wołomin (Dalej: Mdk Lub Obiekt), 3)Wykonać Przedmiot Umowy Zgodnie Z Zasadami Wiedzy Technicznej I Sztuki Budowlanej, Obowiązującymi Przepisami I Polskimi Normami, Aprobatami I Deklaracjami Zgodności Oraz Najnowszą Wiedzą Techniczną Oraz Należytą Starannością,4)Wykonać I Oddać Zamawiającemu Przedmiot Niniejszej Umowy W Terminie W Niej Uzgodnionym,5)Do Załatwienia Wszelkich Formalności W Imieniu Zamawiającego Z Gestorami Sieci W Przypadku Konieczności Usunięcia Kolizji Lub Przyłączenia Obiektu Do Sieci Cieplnej, Wodociągowej, Kanalizacyjnej, Power And Telecommunications, Including The Necessary Permits, Arrangements, Preparation Of Design Documentation Necessary To Remove Conflicts And Connect The Facility To The Above-Mentioned Network And Incurring The Related Costs, 6) Perform The Necessary Technical Tests Of The Completed Installations And Installed Devices, Perform Technological Commissioning, Protocol Handover Of The Subject Of The Contract For Operation With The Active Participation Of The Ordering Partys Representatives, 7) Prepare Multi-Sector, Complete As-Built Documentation, 8) Transfer To The Ordering Party The Economic Copyrights To The Works Created As A Result Of The Execution Of This Contract In Accordance With § 12 Of This Contract, Including Multi-Sector As-Built Documentation, 9) Obtain On Behalf Of The Ordering Party, Opinions, Consents, Arrangements And Decisions Necessary For The Implementation And Use Of The Investment That Affect The Use Of The Facility.
