1. The Subject Of The Order Is The Construction Of A New Headquarters Of The Police Station In Głuszyca (Głuszyca, Ul. H. Sienkiewicza 18A, Plot No. 828/2, District Głuszyca 1, Area 3,375 M2) Carried Out In The Design And Build Mode.1.1. The Subject Of The Order Includes: A) Development Of Design And Cost Estimate Documentation, B) Development Of Executive Documentation, C) Carrying Out All Activities To Obtain Appropriate Permits And Decisions, D) Performing Authors Supervision, E) Execution Of Construction Works In Accordance With The Documentation Developed And Approved By The Ordering Party.1.2. The Ordering Party Described The Subject Of The Order Using A Functional And Operational Program And Its Annexes (Appendix No. 1 To The Swz). 1.3. The Terms And Conditions Of The Order Execution Were Described By The Ordering Party In Annex No. 2 To The Swz, I.E. Ppu (Designed Provisions Of The Contract).2. Code And Name Of The Common Procurement Vocabulary (Cpv): 45216111-5 Construction Works In The Field Of Police Stations3. Partial Offers. The Subject Of The Order Constitutes One Part. The Ordering Party Did Not Divide The Subject Of The Contract Into Parts Due To The Fact That The Execution Of Individual Stages Or Works Included In The Scope Of The Subject Of The Contract Are Closely Related To Each Other. The Implementation Of The Subject Of The Order By More Than One Contractor Could Violate The Technical Integrity Of The Facility. The Execution Of The Subject Of The Order By One Contractor May Guarantee The Ordering Party The Correct Achievement Of The Assumed Investment Goal And The Correct Enforcement Of Rights Resulting From The Guarantee And Warranty For Defects. 4. Employment Based On An Employment Contract.4.1. The Contractor Or Subcontractor Is Obliged To Employ, Within The Meaning Of Art. 22 § 1 Of The Act Of 26/06/1974. Labor Code (Consolidated Text: Journal Of Laws Of 2025, Item 277, As Amended) Or Similar Provisions Of The Eu And Eea Member States, When Executing The Order Of Persons Performing Physical Activities Directly Related To The Performance Of Construction Works Throughout The Entire Period Of The Order, Including Operators Of The Contractors Equipment. Persons Performing Independent Technical Functions In Construction Within The Meaning Of Prbud And Persons Performing Measurements And Commissioning Of Devices And Installations, Deliveries Of Goods, Transport Services, Loading And Unloading Are Excluded From This Obligation. 4.2. The Employment Of The Persons Referred To Above Will Take Place Before The Date On Which These Persons Begin To Perform Activities Under This Agreement And No Later Than On The Date On Which A Given Person Begins To Perform Activities. The Contractor Will Submit To The Ordering Party A Declaration Of Employment Of Individual Persons Under An Employment Contract For The Implementation Of The Task, Specifying The Validity Dates Of The Contracts And The Working Positions Of The Employed Persons, No Lat
