Kozielska With The Ostropa Bypass And Ul. M Kuleszy - Stage I Extension Of Sowińskiego Street. Preparation Of A Land Development Design, Architectural And Construction Design And Technical Designs For The Task: Construction Of A Road System Connecting Ul. Kozielska With The Ostropa Bypass And Ul. M Kuleszy – Stage I: Extension Of Ul. Sowińskiego With A Total Length Of Approximately 0.62 [Km] Scope Of The Project Covered By The Design: The Subject Of The Study Is The Preparation Of Complete Design Documentation Necessary To Obtain A Permit For The Implementation Of A Road Investment Consisting In The Construction Of A Public Road Connecting The Intersection Of Ul. M. Kuleszy From Ul. Sowińskiego Towards The Internal Road Marked As 02Kdz 1/2 In The Local Development Plan With A Planned Roundabout On The Currently Implemented Extension Of Ul. Chemiczna In Gliwice (Section From The Intersection With Ul. Kozielska According To The Design Of The Infracad Road Design Studio), In Accordance With The Concept Attached To The Opz. A Detailed Description Of The Subject Of The Order Is Included In Annex No. 7 To This Tor. The Ordering Party Awards The Contract In Parts, Each Of Which Is The Subject Of A Separate Procedure. Reasons For Not Making This Order For Parts: The Procedure Constituting The Subject Of This Order Covers A Coherent, Interpenetrating And Interdependent Area In Terms Of Traffic Analyzes And Traffic Organization. Therefore, Division Into Parts Would Not Bring The Results Expected By The Ordering Party. Additionally, This Would Result In The Need For Additional Actions On The Part Of The Ordering Party To Coordinate The Activities Of Several Designers. Failure To Complete The Order Comprehensively Could Jeopardize Its Proper Execution. It Should Also Be Noted That The Issue Of Divisibility Of The Benefit Is Not Regulated In The Public Procurement Law, Therefore, In Accordance With Art. 8 Section 1 Of The Act - The Ordering Party Shall Apply The Provisions Of The Civil Code In This Respect, In Particular Art. 379 § 2, According To Which A Benefit Is Divisible If It Can Be Partially Satisfied Without A Significant Change In Its Subject Or Value. Taking The Above Into Account, It Should Be Considered That The Performance Cannot Be Partially Fulfilled Without A Significant Change In The Subject Matter, Which Means That It Should Be Treated As One Whole. At The Same Time, The Lack Of Division Of The Order Into Lots Does Not Restrict Competition And Ensures Equal Access For Entities From The Small And Medium-Sized Enterprise Sector. The Task Included In The Proceedings Plan - Item 2.3.6 Required Warranty Period: The Warranty Period Will Last From The Date Of Final Acceptance Of The Subject Of The Contract, Until The Expiry Of The Guarantee And Warranty For The Investment Made On The Basis Of The Prepared Documentation, But No Longer Than 5 Years From The Date Of The Protocol Acceptance Of The Prepared Documentation.
