3.1. The Subject Of The Order Is: The Subject Of The Order Is The Reconstruction Of Municipal Road No. 170 415 C Polichnowo-Stary Bogapomóz3.2. The Ordering Party Does Not Allow The Submission Of Variant Offers. 3.3. The Ordering Party Does Not Provide For The Selection Of The Most Advantageous Offer With The Possibility Of Negotiations.3.4. A Detailed Description Of The Subject Of The Order Is Included In The Land Development Design. Construction Works Should Be Carried Out In Accordance With The Design Documentation. The Basis For Estimating The Lump Sum Price Is The Design Documentation Supplemented With Swz Provisions. 3.4.1. The Design Documentation Describes The Subject Of The Order In Detail, And The Requirements Specified At Least In One Place Are Binding On The Contractor As If They Were Included In The Entire Documentation. The Contractor May Not Use Errors Or Omissions In The Documents, And Should Immediately Notify The Ordering Party Of Their Detection, Who Will Make Appropriate Changes And Corrections. 3.4.2. Before Submitting The Offer, The Contractor Is Obliged To Make A Site Visit (Confirmed By A Protocol Signed By An Employee Of The Commune Office) At The Construction Site, Including Taking Measurements Of The Works That Are The Subject Of The Order. The Risk Of Failure To Fulfill This Obligation Will Be Borne By The Contractor In Accordance With Art. 226 Section 1 Point 18.3.4.3. In The Event Of Any Doubts Or Discrepancies As To The Description Of The Subject Of The Order, Arising Both At The Stage Of The Tender Procedure And During The Execution Of The Order, The Contractor Is Obliged To Indicate Them To The Ordering Party In Writing. 3.4.4. Completing All Formalities And Costs Related To The Execution Of The Subject Of The Order Is The Responsibility Of The Contractor And Is Included In The Offer Price. The Contractor Will Have To Mark The Area Where Construction Works Will Be Carried Out In A Way That Protects People Not Employed On The Construction Site From Entering The Site And In Accordance With The Relevant Regulations.3.4.5. The Contractor Secures The Work Site, In Particular With Regard To The Employers And Its Own Property. During The Performance Of The Works, The Contractor Is Responsible For The Safety Of Its Employees And Other Persons Located Within The Transferred Construction Site Due To The Works Being Carried Out. The Contractors Obligation Will Be To Ensure And Comply With Health And Safety Conditions, Secure The Interests Of Third Parties, Repair Any Damage Caused During Implementation, And Protect Property Related To The Construction (Contractors Materials And Equipment And Users Property).3.4.6.
