Tenders Are Invited For Providing 24-Hour Care And Living Services In The Arka Family Nursing Home, Which Provides Places For People Requiring Support

1. The Subject Of The Order Includes The Provision Of 24-Hour Care And Living Services By Running The Arka Family Care Home, Which Provides Places For 3 To 8 People Requiring Support Due To Age Or Disability, Located In A Single-Family Residential Building Located In Mołtajny 21A, 11-410 Barciany.2. The Subject Of The Order Will Be Performed Based On The Provisions Of: 1) The Act Of March 12, 2004 On Social Assistance (Journal Of Laws Of 2025, Item 1214, As Amended), In Particular Art. 52 Of This Act,2) Regulation Of The Minister Of Labor And Social Policy Of July 27, 2024 On Family Care Homes (Journal Of Laws Of 2024, Item 1129).3. 24-Hour Care And Living Services Constituting The Subject Of The Contract May Be Provided By: 1) A Natural Person Running A Family Care Home In Which This Person Will Live, 2) An Authorized Entity, I.E. A Non-Governmental Organization Referred To In Art. 3 Section 2 Of The Act Of April 24, 2003 On Public Benefit Activities And Volunteering (Journal Of Laws Of 2023, Item 571 And Of 2024, Item 834) Or The Entity Mentioned In Art. 3 Section 3 Of This Act, Conducting Social Assistance Activities - In The Case Of A Family Care Home Run By An Authorized Entity.4. The Residential Building In Which 24-Hour Care And Living Services Will Be Provided Through The Arka Family Care Home Is The Property Of The Barciany Commune. A Lease Agreement Will Be Signed With The Selected Contractor For The Duration Of The Order. Only The Arka Family Care Home Can Be Run In The Building.5. A Detailed Description Of The Subject Of The Order Is Included In Annex No. 3 To The Specification Of The Terms Of The Order, Hereinafter Referred To As Swz.6. The Subject Of The Order Will Be Carried Out Divided Into The Following Stages: 1) Stage I - Covering The Implementation Of The Subject Of The Order In 2026, 2) Stage Ii - Covering The Implementation Of The Subject Of The Order In 2027, 3) Stage Iii - Covering The Implementation Of The Subject Of The Order In 2028 - In The Event Of Launching The Option, 7. If There Are No Financial Resources For The Implementation Of The Subject Of The Contract Within Stages Ii Or Iii, The Ordering Party Will Withdraw From The Implementation Of This Stage/Those Stages, And In Such A Case The Contractor Will Only Be Entitled To The Remuneration Due For The Performance Of Part Of The Contract Until The Date Of Withdrawal. Provisions Regarding The Payment Of A Contractual Penalty By The Ordering Party For Withdrawal From The Contract For Reasons Attributable To The Ordering Party Do Not Apply In This Case.8. The Contractor Is Obliged To Perform The Order In Accordance With The Principles Of Modern Knowledge And Applicable Regulations, As Well As With Respect For Occupational Health And Safety Principles.
