1. The Subject Of The Order Is The Implementation Of An Investment Task Entitled: Retrofitting The Air Conditioning System In The Building Of Public Kindergarten No. 2 In Marki, Ul. Duża 1A.2. The Detailed Scope Of Construction Works That Are The Subject Of This Order Is Specified In The Design Documentation, I.E. The Technical And Executive Design And The Bill Of Quantities, Constituting Annex No. 1 To The Swz And The Contract Template Constituting Annex No. 2 To The Swz.3. In Addition To The Execution Of Construction Works, The Order Includes Servicing The Installation, Performing Inspections, Maintenance, Reporting Events To The Central Register Of Operators (Cro) And Other Activities Resulting From The Technical And Operational Documentation Of The Device, Necessary To Ensure The Proper Functioning Of The Air Conditioning Installation, Throughout The Warranty Period.4. Subject To The Exceptions Clearly Indicated In The Contract Template Constituting Annex No. 2 To The Swz, Regardless Of Special Circumstances, The Gross Lump Sum Remuneration Referred To Above May Not Be Increased Throughout The Period Of Performance Of The Subject Matter Of The Agreement. However, The Above Does Not Exclude The Possibility Of Increasing The Contractors Remuneration Provided For In Art. 632 § 2 Of The Civil Code.5. The Gross Amount Of Remuneration Must Include The Costs Of All Works Necessary For The Proper Execution Of The Subject Of The Agreement Resulting Directly Or Indirectly From The Design Documentation Or Technical Knowledge And The Costs Of All Works Necessary For The Proper Execution Of The Subject Of The Agreement, In Particular The Costs Of All Preparatory, Cleaning And Development Works Of The Construction Site, The Costs Of Securing The Construction Site, As Well As The Costs Of All Necessary Examinations, Tests, Technical Acceptance And Documents Authorizing Operation And The Costs Of The Contractors Insurance, As Well As Carrying Out, Throughout The Warranty Period: Service And Inspections Necessary For Proper Operation Of Built-In Devices, Installations, Technology Elements And Equipment, At Least Once A Year.6. The Gross Remuneration Amount Must Include The Contractors Risk And Liability For Checking The Agreement And Its Annexes, Taking Into Account Any Inaccuracies, Contradictions Or Incompleteness. The Contractor Is Obliged To Perform, Within The Lump Sum Gross Remuneration Specified In The Agreement, All Work Necessary To Implement The Subject Of The Agreement.7. The Contractor Shall Be Liable To The Ordering Party Under The Warranty For Defects In The Subject Matter Of The Agreement For A Period Of 5 Years. The Warranty Periods Start From The Date Of Final Acceptance Of The Works.8. On-Site Visit: 1) The Ordering Party Appoints A Mandatory On-Site Visit To The Place Where The Works Will Be Carried Out In Order To Familiarize Themselves With The Future Construction Site, The Existing Condition And The Conditions Of The Works Covered By The
