The Subject Of The Order Is The Comprehensive Execution Of Construction And Assembly Works And Supplies Related To The Construction And Equipment Of The Toddler Club As Part Of The Task Entitled: Construction Of Small Architectural Objects For The Playground For The Investment: Reconstruction Of Part Of The Ground Floor Of The Primary School Building In Radostów Pół In Order To Implement The Task Entitled Creation Of 20 New Care Places Under The Active Toddler 2022-2029 Program At The Bajkolandia Childrens Club In Czastary, Radostów Pół 53. 2. As Part Of The Task, The Contractor Is Obliged To Deliver And Assemble The Following Elements: A) Cymbals - 1 Pc. B) Spring Rocker - 1 Pc. C) Mini Town - 1 Pc. D) Play Set - 1 Pc. E) Sandbox With Cover - 1 Pc. F) Slide - 1 Pc. G) Park Bench - 2 Pcs. H) Waste Bin - 1 Pc. I) Playground Regulations - 1 Piece (Note, This Element Is Not Mentioned In The Technical Documentation And Bill Of Quantities).3. The Delivered Assortment Must Be Brand New, Unused, Undamaged And Free From Third Party Rights. The Delivered Assortment Must Be Marked In Accordance With Applicable Regulations, In Particular Safety Signs. Every Childrens Toy Should Have The Ce Marking. The Devices And Materials Used Must Have Certificates And Approvals Confirming The Safety Of Their Construction, Meeting Appropriate Hygiene Conditions And Environmental Protection. They Should Also Have A Technical Product Card Confirming The Parameters Of The Devices In Terms Of Quality, Materials Used And Necessary Required Elements And Dimensions Of The Device, As Well As A Certificate Of Compliance With En 1176 Issued By An Accredited Body.4. All Devices And Equipment Delivered Under The Subject Matter Of The Agreement Must Be Made Of Safe And Durable Materials And Be Brand New And Cannot Be Used For Exhibition Purposes5. The Installed Toys And Devices Must Be Suitable For Children Under 3 Years Of Age. They Must Have Appropriate Approvals And Certificates. 6. The Parameters Presented In The Documentation Constitute The Technical And Qualitative Minimum Expected By The Ordering Party And Will Constitute The Basis For Assessing Possible Equivalent Materials. In Accordance With The Ruling Of The National Chamber Of Appeal Of December 20, 2016 (Ref. No. Kio 2312/16), Equivalent Solutions Should Be Understood As Solutions Characterized By Parameters Not Worse Than Those Required And Included In The Documentation. If The Ordering Party Allows Solutions Equivalent To Those Described In The Documentation, But Does Not Provide The Minimum Parameters That Would Confirm This Equivalence - The Contractor Is Obliged To Offer A Product With Similar Properties That Is Functionally Suitable To The Required Application.” The Contractor Who Uses Equivalent Devices Or Materials Will Be Obliged To Demonstrate During The Execution Of The Order That The Devices And Materials Used By Him Meet The Requirements Specified By The Ordering Party.7.
