1. The Subject Of The Order Is The Provision Of Services For Employees Of The Marshals Office As Part Of A Sports And Recreation Program By Providing Employees, Their Accompanying Persons And Children With Personal Cards Enabling The Use Of Sports And Recreation Services Throughout Poland.2. The Subject Of The Order Should Be Performed In Accordance With The Description Of The Subject Of The Order Constituting Annex No. 1 To Swz.3. The Ordering Party Did Not Divide The Order Into Parts. Explanation Of The Lack Of Division Into Lots: Dividing The Order Into Lots Would Involve Additional Technical Difficulties And Additional Costs Of Order Execution (Several Card Processing Platforms). The Need To Coordinate The Activities Of Various Contractors Implementing Individual Parts Of The Contract Could Involve Additional Tasks During The Execution Of The Contract (Cooperation Of Contractors).4. Other Regulations Regarding The Subject Of The Order Are Included In The Description Of The Subject Of The Order Constituting Annex No. 1 To The Swz And In The Contract Template Constituting Annex No. 2 To The Swz, On The Terms And Conditions Specified Therein, The Contractor Is Obliged To Complete The Order.5. The Ordering Party Does Not Reserve The Right To Apply For The Order Only By Contractors Referred To In Art. 94 Of The Pzp.6 Act. Subcontracting:1) The Contractor May Entrust The Performance Of Part Of The Order To A Subcontractor(S).2) In Connection With The Execution Of The Order, The Ordering Party Does Not Reserve The Obligation To Personally Perform Key Tasks Of The Order. 3) The Ordering Party Requires That In The Event Of Entrusting Part Of The Order To Subcontractors, The Contractor Should Indicate In The Offer The Parts Of The Order The Performance Of Which He Intends To Entrust To Subcontractors And Provide (If They Are Already Known) The Names Of These Subcontractors. 4) Entrusting Part Of The Order To Subcontractors Does Not Release The Contractor From Responsibility For The Proper Performance Of The Contract.7. The Ordering Party, Acting Pursuant To Art. 95 Section 1 And 2 Of The Act Informs That It Requires The Contractor And Subcontractor(S) To Employ, On The Basis Of An Employment Relationship, Persons Who Perform Activities Related To The Execution Of The Order, Consisting In Performing Work In The Manner Specified In Art. 22 § 1 Of The Act Of June 26, 1974 - Labor Code. Activities Related To The Implementation Of The Subject Of The Order, Which The Ordering Party Indicates As Requiring Employment On The Basis Of An Employment Relationship, Are Activities That Require Supervision On The Part Of The Contractor, With The Exception Of: - Activities That Require Running A Business, - Activities That Are Performed Directly And Exclusively By The Contractor. § 2 Sections 9-10 Of The Contract Template).2) Method Of Verifying The Employment Of Persons Referred To In Point 1: The Ordering Party Has The Right To Check The Contractors Compliance With
