Legal Services – Framework Contract Legal Services - Government Contracts (Incl. Training). Framework Agreement For Legal Assistance And Representation In Connection With Public Procurements (Including Training). 1. Object Of The Assignment The Aim Of This Framework Agreement Is To Appoint Specialized Legal Service Providers For Legal Support, Advice And Assistance With Regard To Government Contracts, For The Benefit Of The University Of Antwerp And Any Entrants. Within A University And Research Context, Public Contracts Are Often Placed In An Environment Characterized By Innovative Projects, Specialized Infrastructure And Research Activities, The Future Needs Of Which Cannot Always Be Fully Determined In Advance. This Requires An Innovative Legal Application Of Public Procurement Regulations. The Assignment Relates To Government Contracts For Works, Supplies And Services, And Concessions With Special Attention To: • Complex And Strategic Files; • Files With Increased Legal Or Procedural Risk; • Files Within A University And Research Context, Including Infrastructure And Laboratory Files; • Disputes And Proceedings Arising From Government Contracts; • Targeted Training And Knowledge Transfer. This Contract Concerns A Service Contract Within The Meaning Of Article 2, 21° Of The Act Of 17 June 2016 On Public Procurement And Is Placed In The Form Of A Framework Agreement Within The Meaning Of Article 2, 35° Of The Same Law. Pool Of Service Providers The Framework Agreement Is Concluded With A Pool Of 5 Suppliers. The Participants May Or May Not Be Put Into Competition Again Per Sub-Assignment. (See I.4 - Installation Method) All-In Prices The Hourly Rates Stated Are All-In Rates (Excl. Vat) And Include All Costs Associated With The Services. Relocation Costs, Administrative Costs Or Other Surcharges Cannot Be Charged Separately. 2. Substantive Scope Of The Services The Contractor Provides Specialized Legal Support Within The Field Of Government Contracts. The Services Include, But Are Not Limited To, The Following Components. A. Legal Support During Placement (Advisory And Review) The Contractor Provides Legal Support And Advice To The Contracting Authority During The Placement Of Government Contracts, Without Taking Over The Role Of The Internal Purchasing Service. This Support May Include: • Legal Advice On The Choice And Motivation Of The Placement Procedure (Public, Private, Ovp, Mpo, Competitive Procedure With Negotiation, Etc.); • Legal Screening And Assessment Of: O Selection Guidelines, O Specifications, O Award Criteria And Assessment Methods Drawn Up By The Contracting Authority; • Advice On: O Demarcation And Motivation Of Plots, O Framework Contract Structures, O Purchasing Centers And Entry-Level Companies; • Threshold Analysis And Assessment Against Eu Regulations, Including Risk Analysis.
